In Turkish Public Procurement Law, the type of tender in which non-price attributes are also taken into account together with the price, is used by governmental procurements especially for purchasing of high value engineering systems or projects. Even though this type of tenders brings numerous benefits for both suppliers and the buying entities they are rarely issued just because implementation principles are not clearly set and, the buying entities are delegated for setting the principles. The most challenging issue for buying entities is, on one hand, to establish the principles of bidding for non price multiple attributes and, on the other hand to decide “the economically most advantageous bid” as identified in The Turkish Public Procurement Law. This study is aiming to help buying entities solve both problems and make this type of tenders prevalent.
Türk Kamu İhale Kanununda “Fiyat ile birlikte fiyat dışı unsurların da dikkate alındığı ihale” olarak anılan tür devlete ait satın almalarda özellikle de yüksek değerde mühendislik sistem veya projelerin alımında kullanılmaktadır. Bu ihale türünün hem tedarikçi hem de satın alan idarelere sayısız fayda sağlamasına rağmen uygulama esaslarının çok net olarak ortaya konmaması ve bunu yapmak üzere satın alan idarelerin yetkilendirilmesi yüzünden nadiren kullanıldığı görülmektedir. Satın alan idareler için bu tür ihalelerdeki en sorunlu husus, bir yandan fiyat dışı unsurlar için teklif verme esaslarını oluştururken diğer yandan da Türk Kamu İhale Kanununda tanımlanan “ekonomik açıdan en avantajlı teklifi” seçmektir. Bu çalışma, her iki sorunu da çözmede satın alan idarelere yardımcı olmak ve bu sayede bu tür ihalelerin yaygınlaşmasını sağlamak amacındadır.
