                                                                                                <abstract><p>Günümüzde savaşan taraflar arasında eşitlik ilkesi artık uygulanmamaktadır. Asimetrik savaş kavramı, son yıllarda sıklıkla karşılaştığımız ve giderek daha da önem kazanan bir olgu haline gelmiştir. Uluslararası insancıl hukuka uygun olmayan savaş yöntemlerinin kullanımı artış gösterse de, savaş hukukun sivillere ve savaş dışı kalanlara koruma sağlamak, silahlı çatışmanın neden olduğu zararı azaltmak gibi temel kuralları değişmemektedir. Bu çalışmada öncelikle asimetrik savaşın farklı tanımları, tarihsel arka planı ve insancıl hukukta asimetrik savaş kavramı ele alınmıştır. Bu makale, asimetrik savaşlarda Uluslararası İnsancıl Hukukun (UİH) uygulanabilirliğini, Filistin-İsrail çatışmaları bağlamında ele almaktadır. Filistin ve İsrail arasındaki bu çatışmalar, uluslararası insancıl hukukun uygulanabilirliği ve etkinliğinin sağlanması konusundaki zorlukları göstermesi açısından önemli bir vaka sunmaktadır. Sonuç olarak, asimetrik savaşların karmaşık doğası nedeniyle UİH’un etkin bir şekilde uygulanamadığı, bu durumun da uluslararası toplumun ve ilgili tarafların hukukun üstünlüğünü sağlamak için daha etkin müdahaleler gerçekleştirmesini gerektirdiği sonucuna varılmaktadır. Bu bağlamda, UİH’un geçerliliği ve uygulanabilirliği üzerinde durulmakta, çatışma taraflarına somut öneriler sunulmaktadır.</p></abstract>
