An Analysis of Contemporary Sukuk Applications from the Perspective of Islamic Jurisprudence and Economics
Öz
The primary principle of Islam concerning economic life is the prohibition of interest. From the early periods onwards, this principle has driven Muslims to develop interest-free financial products and establish institutions to implement them. In the last quarter of the 20th century, numerous new financial products were developed worldwide within this framework. In recent years, Turkey has also joined this process, introducing a multitude of financial products to the market on the premise that they are Islamic. While Mudarabah (Muqaradah), Musharakah, and Ijarah certificates were initially the leading alternative capital market instruments, today's most popular product is Sukuk. In our country, the term Lease Certificate is used instead of Sukuk to denote the exact same concept. In post-republic Turkey, the first capital market instruments introduced on the assumption of being interest-free were DESİYAB partnership certificates. Subsequently, Revenue Sharing Certificates, Profit and Loss Sharing Certificates, and Revenue-Indexed Bonds were issued, and most recently, Lease Certificates were offered to the market. Consequently, sukuk has been designed and proposed as a packaged product that, even if on a theoretical level, embodies almost all the characteristics of various independent interest-free financial products issued throughout history based on risk and benefit sharing. In this text, we will examine sukuk in terms of its definition, emergence, fundamental elements, and its jurisprudential status.
