AbstractTherank obtained as a result of an administrative procedure called as promotionplays a key role in the formation of the hierarchy within the military forces,establishment of the command chain, provision and maintenance of thediscipline, and thus fulfillment of the duty. The military person, who meet therequired qualifications of the legislation and rank waiting duration canpromote the upper rank one year earlier. Also exceptionally; if the militarystaff is selected by the Chief of Army Commander, he/she can be promoted oneyear before his/her peers. In the Turkish Military Forces Personnel Law No.926, this promotion is defined as “the seniority of superiority success”,however, it commonly referred as early promotion in the daily language. Earlypromotion is a matter of widespread use of discretion by the administration andthereby it is frequently subject to jurisdiction as a matter of dispute.TheAdministration has a wide margin of discretion in determining thejustifications for the early promotion of the military staff. In the selectionstage, a different selection criterion can be applied for each branch or rankby the administration. The justification for the promotion is not disclosed topublic. Moreover, early promotions which are not compatible with the essence ofthe law are made and errors are made in the calculation of the serviceduration. In this study, the early promotion system is discussed in the lightof the principles and rules of administrative law and judicial decisions. Inaddition, a number of recommendations have been presented to make the existingsystem more predictable.

Kanunun aradığı şartları taşıyanpersonel, rütbe bekleme süresini doldurduğunda normal olarak bir üst rütbeyeterfi etmektedir. Ayrıca istisnai olarak; belirli konularda üstün başarıgöstermiş personel, Kuvvet Komutanı tarafından seçildiği takdirde emsallerindenbir yıl önce terfi edebilmektedir. 926 sayılı Türk Silahlı Kuvvetleri PersonelKanunu’nda “üstün başarı kıdemi” olarak geçen, günlük dilde “mümtaz terfi” yada “erken terfi” olarak ifade edilen “üstün başarı kıdemi nedeniyle erkenterfi” işlemi; idarenin takdir yetkisinin yaygın olarak kullanıldığı ve bunedenle uyuşmazlık konusu olarak sıkça yargıya taşınan bir konudur.İdare,erken terfi ettireceği personeli seçerken, üstün başarı kıdemi nedeniyle erkenterfi sebeplerinden herhangi birine dayanma konusunda geniş bir takdiryetkisine sahiptir. Her sınıf ve/veya rütbe için farklı bir sebebe dayanmaserbestisini dahi içeren geniş bir takdir yetkisi, terfi onayında kimin hangigerekçeyle terfi ettiğinin açıklanmaması, konunun özüyle uyumlu olmayan erkenterfi sebeplerinin varlığı, subaylıkta geçen hizmet süresinin hesabında yapılanhatalar ve uygulamadan kaynaklanan sorunlar; bu çalışmada, idare hukuku ilke vekuralları ile yargı kararları ışığında ele alınmış ve mevcut sistemin dahaöngörülebilir bir yapıya kavuşturulması maksadıyla birtakım çözüm önerilerigeliştirilmiştir.
