Hukuki belgelerde yer alan temel haklardan biri de siyasi faaliyetlerde bulunma hakkıdır. Bu çalışmada siyasi faaliyet kapsamında olan siyasi katılım hakkı, göçmenler/vatandaş olmayanlar özelinde incelenmiştir. Ulus-devlet söyleminin yükselmesiyle kamu ve ulus güvenliğinin savunulması sonucu göçmenlere/vatandaş olmayanlara yönelik bazı haklar sınırlanmıştır. Bu süreçte sınırlama getirilen haklardan birisi de siyasi katılım hakkıdır. Bu çalışmanın amacı, ulus-devlet ve göç ilişkisi bağlamında göçmenlerin siyasi katılım hakkına dair genel bakış sunmaktır. Çalışma, belirlenen on bir ülkede göçmenlerin siyasi katılım haklarını oy kullanma bağlamında ele almaktadır. Literatürde spesifik olarak bir ülkenin siyasi katılım hakkını ele alan çalışmalar var olsa da genel bir bakış sunan çalışmaların sınırlılığı bu çalışmayı önemli kılmaktadır. Çalışma nitel araştırma tekniklerinden doküman analizi ile gerçekleştirilmiştir. Araştırmada göçmenlere/vatandaş olmayanlara belli kıstaslara bağlı olarak siyasi katılım hakkının verildiği, genellikle bölgesel ve ulusal seçimlerden ziyade yerel düzeydeki seçimlere katılabilme hakkına sahip oldukları ve Avrupa Birliği’ne üye devletlerde vatandaş olmayanların seçimlere katılma durumunun diğer ülkelere göre daha olağan karşılandığı sonucuna ulaşılmıştır. Ayrıca bu bağlamda siyasi katılım hakkını içeren uluslararası ve bölgesel belgeler belirlenmiş ve açıklanmıştır. Hukuki belgeler arasında tüm devletler için bağlayıcı veya emredici bir belgenin mevcut olmadığı anlaşılmıştır. Güvenlikleştirme teorisi bağlamında, ulus-devlette vatandaş olmayanlara siyasi katılım hakkı verilmesinin önünde engel oluştuğu anlaşılmış ve kent vatandaşlığı önerilmiştir. Çalışma sonucunda; göçmenlerin insan haklarının siyasi katılım haklarını da içerecek şekilde genişletilmesi, vatandaş olmayanların da temsil edilmesi ve hayatı derinden etkileyen iktidarın oluşumuna katılabilmeleri insan hakları temelinde desteklenmiştir.
One of the fundamental rights enshrined in legal documents is the right to engage in political activities. In this study, the right to political participation, which is within the scope of political activity, is analyzed in the case of immigrants/non-citizens. With the rise of the nation-state discourse, some rights of immigrants/non-citizens have been restricted as a result of the defense of public and national security. One of the rights restricted in this process is the right to political participation. This study aims to provide an overview of migrants' right to political participation in the context of the relationship between nation-state and migration. The study analyses the political participation rights of migrants in eleven countries in the context of voting. Although there are studies in the literature that specifically address a country's right to political participation, the limited number of studies that provide an overview makes this study important. The study was conducted through document analysis, one of the qualitative research techniques. In the study, it was concluded that immigrants/non-citizens are given the right to political participation depending on certain criteria, that they generally have the right to participate in local elections rather than regional and national elections, and that the participation of non-citizens in elections in the member states of the European Union is considered more normal than in other countries. In this context, international and regional instruments that include the right to political participation have been identified and explained. It understood that there is no binding or mandatory document for all states among legal documents. In the context of securitization theory, it understood that there is an obstacle to granting the right to political participation to non-citizens in the nation-state, and urban citizenship is proposed. As a result of the study; the extension of human rights of migrants to include political participation rights, the representation of non-citizens, and their participation in the formation of power that deeply affects life are supported based on human rights.
