Antik Yunan’dan itibaren “zoon politikon” olarak tanımlanan insan, bu anlamda toplumsal bir varlık olması sebebiyle davranışlarını yalnızca kendi istekleri doğrultusunda belirleme şansına sahip değildir. Bu durum, şans kavramından öte hak kavramıyla açıklanmaya girişildiğinde, karşımıza toplumsal değer yargılarıyla ilişkili iki kavram çıkmaktadır: ahlak ve hukuk. Bu iki kavram arasındaki ilişki tarih boyunca düşünürlerce farklı bakış açıları çerçevesinde değerlendirilmiştir. Bu çalışmada, toplumsal anlamda iyi olan ile doğru olanın arasındaki bu ilişki, Cicero’nun yükümlülük anlayışı ile Kant’ın ödev ahlakı arasındaki bağlantı ya da bağlantısızlık bağlamında incelemeye tabi tutulacaktır.
Human being which is described as "zoon politikon", because of being a social creature in that meaning, doesn't have the chance to determine its behaviors according to its wishes only. While this situation is tried to explain within not the concept of chance but the concept of right, we face with two notions, which are related with the social value judgments: morality and law. The relation between these two notions is commentated in the frames of different perspectives by thinkers through the history. In this article, that relation which is between socially good and right will be examined in the context of the connection or disconnectedness of Cicero's conception of obligation and Kant's duty-based ethics.
