In construction projects, some unforeseen problems, shortcomings, or mistakes in the determination of the land, the design phase, the preparation of tenders, contracts, and construction works affect many parameters such as the quality, duration, and budget of the construction project. Many factors such as defective construction of the work, delays in project duration, delayed payments or unpayments at all, change orders or unforeseen site conditions can cause claims between the employer, the contractor and the third parties and can lead to disputes between the parties as a result of lack of communication. This circumstance leads to one of the parties either taking the unresolved dispute to court or resorting to alternative dispute. In this study, the factors causing disputes between the parties are identified through literature findings, relevant legislations, and the various Supreme Court decisions. Recommendations are then developed for academic and sector-based stakeholders in order to minimize the effects of disputes on projects and mitigate the judicial burden in resolving these disputes. In addition, within the scope of the study, five sample cases with different major causes are investigated under the subheadings of; namely; plaintiffs, defendants, type of the contracts, the subject of the contracts, decisions taken by the Supreme Court, reasoning behind the decisions, and interpretation of the decisions.
İnşaat projelerinde; arsanın belirlenmesi, tasarım aşaması, ihale ve sözleşmelerin hazırlanması sırasında ve eserin yapım sürecinde öngörülemeyen birtakım hususlar, eksiklikler veya yapılan hatalar; inşa edilen eserin kalitesi, süresi ve bütçesi gibi birçok parametresini etkilemektedir. Eserin kalitesiz/ayıplı inşası, proje süresinde yaşanan gecikmeler, ödemelerin gecikmesi veya yapılmaması, değişiklik talepleri veya farklı saha koşullarından kaynaklı birçok faktör, işveren, yüklenici ve üçüncü kişiler arasında hak taleplerinin ortaya çıkmasına neden olmakta ve iletişim kanallarının da açık olmaması sonucunda da taraflar arasında birtakım uyuşmazlıklara neden olabilmektedir. Bu durum uyuşmazlıkların çözümü için taraflardan birinin mahkemelere veya alternatif uyuşmazlık çözüm yöntemlerine başvurması ile sonuçlanmaktadır. Bu çalışmada taraflar arasında uyuşmazlıklara neden olan unsurlar; literatür bulguları, ilgili mevzuat ve Yargıtay kararları ile belirlenmiştir. Çalışmada uyuşmazlıkların projeler üzerindeki etkisinin en aza indirilmesi ve uyuşmazlıkların çözümünde yargı yükünün hafifletilebilmesi için literatüre ve sektör paydaşlarına öneriler geliştirilmiştir. Çalışma kapsamında ayrıca, ana nedenleri farklı olan beş örnek vaka; davacı, davalı, sözleşme türü, sözleşme konusu, Yargıtay kararı, kararın gerekçesi ve yorumu başlıkları altında incelenmiştir.
