                            <p>In Swiss civil procedure law, it is stipulated that the parties apply for a compulsory conciliation before filing an action, and compulsory conciliation is regulated as a condition of litigation. Compulsory conciliation is carried out by a conciliation authority independent of the administration. In compulsory conciliation, the conciliation authority guides the parties to end the dispute between them without resorting to litigation, taking into account the legal status of the parties in terms of the concrete dispute. In Swiss law, the compulsory conciliation authority has been granted some powers, such as the power to propose judgments to the parties in terms of certain disputes and to adjudicate the dispute upon request in disputes if the value in dispute does not exceed 2,000 Swiss frank. In this study, the compulsory conciliation institution regulated between articles 197 and 212 of the Code of Swiss Civil Procedure will be examined in general.</p></trans-abstract>
                                                                                                                                    <abstract><p>İsviçre medenî usûl hukukunda kural olarak tarafların dava açmadan önce zorunlu uzlaştırmaya başvurmaları öngörülmüş ve zorunlu uzlaştırma bir dava şartı olarak düzenlenmiştir. Zorunlu uzlaştırma, idareden bağımsız bir uzlaştırma mercii tarafından yürütülür. Zorunlu uzlaştırmada uzlaştırma mercii, tarafların somut uyuşmazlık bakımından hukukî durumlarını gözeterek, taraflara aralarındaki uyuşmazlığı dava yoluna başvurmadan sona erdirmeleri için rehberlik eder. İsviçre hukukunda zorunlu uzlaştırma merciine, bazı uyuşmazlıklar bakımından taraflara hüküm önerisinde bulunma ve talep üzerine uyuşmazlık değeri 2.000 İsviçre frangını geçmeyen uyuşmazlıklarda, uyuşmazlığı karara bağlama yetkisi gibi bazı yetkiler tanınmıştır. Çalışmada İsviçre Federal Usûl Kanunu’nun 197. ilâ 212. maddelerinde düzenlenen zorunlu uzlaştırma kurumu genel hatlarıyla incelenecektir.</p></abstract>
