Bu çalışma; insan hakları hukukunun en temel ilkelerinden olan eşitlik ilkesi ve eşitlik ilkesini tamamlayan ilkelerin 20 Latin Amerika ülkesinin Anayasası çerçevesinde incelenmesini konu edinmektedir. Araştırmanın amacı Latin Amerika ülkelerinin tarihsel, ekonomik, sosyal, coğrafi ve kültürel özgünlüklerinin eşitlik ilkesi ve eşitlik ilkesini tamamlayan ilkeler bağlamında yansımasına dair veri elde etmektir. Çalışma, Anayasalardaki düzenlemelerin İnsan Hakları Evrensel Bildirgesi, Amerikan İnsan Hakları ve Ödevleri Bildirgesi ve Amerikan İnsan Hakları Sözleşmesi’nde yer alan düzenlemeler ile karşılaştırmalı olarak incelenmesi şeklinde gerçekleştirilmiştir. Araştırmadan elde edilen veriler hem uluslararası insan hakları hukukunda önemli bir konu olan kültür ve insan hakları hukuku ilişkisi tartışmalarına hem de eşitlik ilkesi ve eşitlik ilkesini tamamlayan ilkeler bağlamındaki literatüre katkı sunması açısından değerlidir.Çalışmada; öncelikle araştırma konusunun teorik olarak genel çerçevesi ortaya konulmuştur. Ardından araştırma verileri dört başlık altında incelenmiştir. Eşitlik ve eşitlik ilkesini tamamlayan ilkelerle ilgili genel tespitler yapıldıktan sonra ilk bölümde eşitlik ilkesi ile ilgili düzenlemelere dair veriler sunulmuş ve değerlendirilmiştir. İkinci bölümde eşitlik ilkesini tamamlayan ayrım, ayrıcalık ve ayrımcılık yasağı ilkelerine dair veriler analiz edilmiştir. Üçüncü bölümde Anayasalarda eşitlik ilkesi ve eşitlik ilkesini tamamlayan ilkeler süje ve muhatap bağlamında incelenmiştir. Son bölümde ise eşitlik ilkesi ve bu ilkeyi tamamlayan düzenlemelerde devletin pozitif yükümlülüğü ile cezai yaptırıma dair düzenlemeler analiz edilmiştir. Sonuç bölümünde de tüm veriler değerlendirilmiştir. Çalışmaya kaynak olan ülkelerin anayasaları Constitute Project adlı internet sitesinde yer alan İngilizce metinler kullanılarak incelenmiş, metinde belirsizlik olması durumunda söz konusu devletlerin kendi resmi dillerindeki anayasaları dikkate alınmıştır.
This work is about examining the principle of equality, one of the most fundamental principles of human rights law, and the principles that complement the principle of equality within the framework of the Constitutions of 20 Latin American countries. The aim of the research is to obtain data on the reflection of the historical, economic, social, geographical and cultural uniqueness of Latin American countries in the context of the principle of equality and the principles that complement the principle of equality. The study was carried out by examining the regulations in the Constitution comparatively with the regulations in the Universal Declaration of Human Rights, the American Declaration of the Rights and Duties of Man and the American Convention on Human Rights.The data obtained from the research are valuable in terms of contributing both to the discussions on the relationship between culture and human rights law, which is an important issue in international human rights law, and to the literature in the context of the principle of equality and the principles that complement the principle of equality.In the study; First of all, the theoretical general framework of the research subject is presented. Then, the research data was examined under four headings. After making general determinations about the principle of equality and the principles that complement the principle of equality, data on the regulations regarding the principle of equality are presented and evaluated in the first section. In the second part, data on the principles of prohibition of distinction, prohibition of privilege and non-discrimination, which complement the principle of equality, were analyzed. In the third chapter, the principle of equality in Constitutions and the principles that complement the principle of equality are examined in the context of subject and addressee. In the last section, the principle of equality and the regulations regarding the positive obligation of the state and criminal sanctions in the regulations that complement this principle are analyzed. In the results section, all data were evaluated.The constitutions of the countries that are the source of the study were examined using the English texts on the website called the Constitute Project, and in case of ambiguity in the text, the constitutions of the states in question in their own official languages were taken into account.
