In the present study, we aimed to investigate the current structural problems of the sports arbitration system in Turkey and to develop a centralized model proposal in accordance with international standards. The study group consisted of 10 experts (lawyers and academics) with at least 10 years of experience in the field of sports law, selected through purposeful sampling. The phenomenology design, one of the qualitative research methods, was used in the study. Data were collected via a semi-structured interview form and subjected to content analysis using Maxqda software. Results revealed a strong participant perception of a lack of merit and structural dependency in the appointment processes of current arbitration boards. It was found that the dual structure (TFF and GSB) leads to a lack of uniformity in decisions and that violations of the right to a fair trial specified in ECHR precedents, such as the Ali Rıza and Others case, continue. Consequently, an independent "Turkish Sports Arbitration Court" (TSTM) model is proposed for Turkey. This model includes a commission (TSTMK) providing administrative autonomy, a specialized chamber system, and judicial review by the Court of Cassation and the Constitutional Court. It is evaluated that the proposed model will establish trust in the sports judiciary and ensure compliance with international norms.
Bu çalışmada, Türkiye’deki spor tahkim sisteminin mevcut yapısal sorunlarını incelemeyi ve uluslararası standartlara uygun merkezi bir model önerisi geliştirmeyi amaçladık. Araştırmanın çalışma grubunu, amaçlı örnekleme yöntemiyle seçilen ve spor hukuku alanında en az 10 yıllık deneyime sahip 10 uzman (avukat ve akademisyen) oluşturmaktadır. Araştırmada nitel araştırma yöntemlerinden fenomenoloji deseni kullanılmıştır. Veriler yarı yapılandırılmış görüşme formu aracılığıyla toplanmış ve Maxqda yazılımı kullanılarak içerik analizine tabi tutulmuştur. Bulgular, mevcut tahkim kurullarının atama süreçlerinde liyakat eksikliği ve yapısal bağımlılık olduğuna dair güçlü bir katılımcı algısı olduğunu ortaya koymuştur. İkili yapının (TFF ve GSB) kararlarda yeknesaklık sorununa yol açtığı ve AİHM’in Ali Rıza ve Diğerleri kararı gibi emsal kararlarında belirtilen adil yargılanma hakkı ihlallerinin devam ettiği tespit edilmiştir. Sonuç olarak, Türkiye için bağımsız bir "Türk Spor Tahkim Mahkemesi" (TSTM) modeli önerilmiştir. Bu model; idari özerkliği sağlayan bir komisyon (TSTMK), ihtisaslaşmış daire sistemi ve Yargıtay ile Anayasa Mahkemesi denetimini içermektedir. Önerilen modelin, spor yargısında güveni tesis edeceği ve uluslararası normlarla uyum sağlayacağı değerlendirilmektedir.
