                                                                                                <abstract><p>Son otuz yılda hukuk teorisi alanının belki de en çok tartışılan ismi olan ama yaşamında uluslararası hukuk alanında neredeyse hiçbir eser vermeyen ve hatta çalışmalarında da çok sınırlı bir şekilde bu alandan bahseden Dworkin’in, ölümünden sonra yayımlanan “A New Philosophy for International Law” isimli eseri, çok büyük bir sürpriz olarak karşılanmıştır. Doğrudan uluslararası hukuku ilgilendiren ilk ve tek çalışmasında Dworkin ilk olarak uluslararası hukuk disiplininin varlığına yönelik eski bir tartışmayı -Uluslararası hukuk, hukuk mudur?- hatırlatarak başlar. Yazar 20. Yüzyılın ortalarından itibaren uluslararası hukuk disiplininin en önemli tartışmalarından birisinin uluslararası hukukun hukuki niteliği üzerine şekillendiğini belirtir. Devamında ise her ne kadar günümüzde uluslararası hukukun varlığı üzerine ciddi bir uzlaşı oluşsa da Dworkin’e göre uluslararası hukukun kaynakları ve kurallarının yorumlanması açısından yukarıdaki soru hala geçerliliğini ve önemini koruyor. Yazar böylelikle uluslararası hukukun, doğasını ve hukuki niteliğini tekrar tartışmaya açar. Bu çalışma, Dworkin’in uluslararası hukuk teorisi için önerdiği argümanları “A New Philosophy for International Law” çalışmasıyla sınırlı kalmamak üzere eleştirel bir şekilde tartışmayı amaçlamaktadır.</p></abstract>
                                                                                                                                    <trans-abstract xml:lang="en">
                            <p>The posthumously published article “A New Philosophy for International Law” by Ronald Dworkin, who is probably one of the most discussed legal philosophers in the field of legal theory in the last thirty years, but who provided no specific work on international law and even provided very limited thought on this field during his career, has been received as a great surprise. In his first and only work that directly concerns international law, Dworkin begins by recalling an old debate - is there international law? - regarding the existence of the discipline of international law. The author states that since the beginning of the 20th century, one of the most significant arguments in the field of international law has been shaped based on the legal character of international law. Dworkin then argues that while there is a serious consensus on the existence of international law today, the question above still remains valid and important in terms of the interpretation of the sources and rules of international law. By doing so, the author re-opens the nature and legal character of international law. This article aims to critically discuss Dworkin’s arguments for a new theory for international law, including but not limited to his work “A New Philosophy for International Law”.</p></trans-abstract>
