13/3/2018 tarih 7102 sayılı “SeçimlerinTemel Hükümleri ve Seçmen Kütükleri Hakkında Kanun ile Bazı KanunlardaDeğişiklik Yapılmasına Dair Kanun” ile siyasi partilerin, seçimlere ittifakyaparak girmelerine olanak sağlanmıştır. Seçim ittifakı düzenlemesinin, ittifakyapan siyasi partilere sağladığı temel iki avantaj; ittifak yapan siyasipartilerin aldıkları oy toplamına göre seçim barajına tabi olmaları ve ittifakyapan siyasi partilerin milletvekili sayılarının hesaplanmasında ittifakıntoplam oyunun esas alınmasıdır. Bu çalışmada, hükümet sistemi değiştikten sonrayapılan ilk seçim kanunu değişikliği olan bu düzenlemenin yeni sistemle uyumu,temsilde adalet ilkesi nazarıyla değerlendirilmektedir. Ayrıca ittifak düzenlemesininseçim barajına etkisi tartışılmakta; son olarak da ittifak düzenlemesiyle gelenittifak oylarının hesaplanması ile ittifak ortak oylarının partileredağıtılmasına ilişkin düzenlemeler temsilde adalet ilkesi ışığında tahlil edilmektedir.
With the "Amendments to the Law on Basic Provisions on Electionsand Voter Registers and Some Laws", (Law No. 7102 on 13/3/2018) politicalparties are allowed to participate in the elections by forming pre-electoral alliance.The main two advantages of electoral alliance regulations for allied politicalparties are; they will be subject to the election threshold according to thetotal votes of the political parties in the alliance and the calculation of thenumber of deputies of political parties that make alliances is based on thetotal votes of the alliance. Turkey's electoral law amendment is investigatedin the context of presidential system with the point of “fair representation”view. The effect of the alliance regulation on the electoral threshold and thecalculation of the alliance votes counts and the distribution of the “alliance'scommon votes” to the parties has been analyzed.
