As a rule, members of trade unions who are party to collective labor agreements have the right to benefit from collective labor agreements. However, Law No. 6356 also allows workers who work in the workplace and who are not members of the trade unions to benefit from collective labor agreements in some cases. This benefit is possible with the written approval of the trade union or by paying solidarity dues. Law No. 6356, Article 26/4 and Article 39 includes about the regulations on this subject. In some cases, the scope of the collective labor agreement applies in a workplace may be extended in terms of location, and it may be applied to workers in other workplaces in the same line of business. The Law No. 6356 Article 40 includes the regulations regarding this utilization, which will be possible with the "Extension" application. The Constitutional Court has recently annulled the provision "requests before the signature date will be effective as of the date of signature" unconstitutional, which was the 4th Article of the Article 39/4 of the Law No. 6356. In this study, after giving general information about collective labor agreements, the issue of benefiting from collective labor agreements was examined in the light of recent developments.
Kural olarak, toplu iş sözleşmesinden yararlanma hakkına toplu iş sözleşmesinin tarafı olan işçi sendikasının üyeleri sahiptir. Ancak 6356 sayılı Kanun bazı hallerde, işyerinde çalışan ve taraf işçi sendikasının üyesi olmayan işçilere de toplu iş sözleşmesinden yararlanma imkânı tanımıştır. Bu yararlanma, taraf işçi sendikasının yazılı onay vermesi veya dayanışma aidatı ödeme yolu ile mümkündür. Konuyla ilgili düzenlemeler 6356 sayılı Kanun m. 26/4 ve m. 39’da yer almaktadır. Bazı hallerde ise, bir işyerinde uygulanan toplu iş sözleşmesinin yer bakımından kapsamı genişletilerek aynı işkolunda bulunan diğer işyerlerindeki işçilere de uygulanması söz konusu olabilir. “Teşmil” uygulaması ile mümkün olacak bu yararlanmaya ilişkin düzenlemeler ise, 6356 sayılı Kanun m. 40’da yer alır. Anayasa Mahkemesi çok kısa bir süre önce dayanışma aidatı ödeme yoluyla toplu iş sözleşmesinden yararlanmayla ilgili olarak 6356 sayılı Kanun’un 39/4. maddesinin 4. cümlesindeki “imza tarihinden önceki talepler imza tarihi itibarıyla hüküm doğurur” hükmünü Anayasa’ya aykırı bularak iptal etmiştir. Çalışmamızda, toplu iş sözleşmesine ilişkin genel nitelikte bilgilere yer verilmiş, ardından güncel gelişmeler ışığında toplu iş sözleşmesinden yararlanma konusu incelenmiştir.
