Abstract

The decision of Federal Court of Justice (BGH) was taken on 4.8.2022 and published on the “Neue Juristische Wochenschrift Rechtsprechungs-Report Zivilrecht” (2022, Issue:18, p. 1288 seq.). The decision was based on the dispute arose due to the so-called “Diesel Scandal”, which has been occured on 18 September 2015 in regard of the diesel automobiles of Volkswagen Group. The subject matter of the decision composes of the question, whether if the amendment of the case before the appeal court is legally possible, and if exceptionally so, the conditions of the submission of the new facts during the appeal stage. (§ 559 ZPO) The legal terms and regulations, which are unfamiliar to Turkish law, are explained in the relevant footnotes.

Abstract

Çevirisi yapılan Alman Yüksek Mahkemesi (BGH) kararı, 4.8.2022 tarihinde verilmiş olup “Neue Juristische Wochenschrift Rechtsprechungs-Report Zivilrecht” dergisinin 2022 yılı 18.sayısında yayınlanmıştır. (2022, s. 1288 vd.) Karar, 18 Eylül 2015 tarihinde ortaya çıkan ve “Dizel skandalı” (Dieselskandal) olarak anılan Volkswagen Group tarafından üretilen dizel otomobillerde yaşanan skandala ilişkin açılan bir uyuşmazlığa ilişkindir. Temyiz incelemesinde dava değişikliğinin mümkün olup olmadığı ve istisnai olarak temyiz aşamasında yeni vakıaların ileri sürülebilmesinin şartları kararın konusunu oluşturmaktadır. (§ 559 ZPO) Çeviride, Türk hukukuna yabancı hukuki terimler ve düzenlemeler, ilgili dipnotlarda açıklanmıştır.
