A COMPARATIVE ASSESSMENT ON THE PROTECTION OF INDIVIDUAL RIGHTS AND PRIVACY IN FACE OF COUNTER-TERRORISM RELATED STATE SURVEILLANCE (UNITED KINGDOM AND TURKEY)

Öz

The main purpose of conducting widespread surveillance activities such as monitoring communications via telecommunications, retaining internet connection records, and placing cameras in public areas is to prevent increasing terrorist incidents in the United Kingdom and Turkey both. The safeguards for the right to respect for private life which are stipulated by surveillance laws should be proportionate and should prevent arbitrariness in accordance with the rule of law. In this sense, it is essential that the oversight mechanisms for security servies should also be operated in a democratic and effective manner. This study, which will emphasise the similar, different and incomplete aspects of surveillance regimes in the UK and Turkey, aims to present the fragile balance between the fight against terror and the protection of private life.

TERÖRLE MÜCADELEDE DEVLETİN GÖZETLEMESİ KARŞISINDA BİREYİN ÖZEL HAYATININ GİZLİLİĞİNİN KORUNMASI HAKKININ KARŞILAŞTIRMALI BİR DEĞERLENDİRMESİ (BİRLEŞİK KRALLIK VE TÜRKİYE)

Öz

Giderek artan terör olaylarının önlenmesi amacıyla Birleşik Krallık ve Türkiye’de, telekomünikasyon yoluyla yapılan iletişimin denetlenmesi, internet bağlantı kayıtlarının saklanması, kamusal alanlara kameraların yerleştirilmesi gibi yaygın bir biçimde gözetleme faaliyetleri yürütülmektedir. Gözetlemenin dayandığı hukuki rejimin, özel hayatın gizliliğinin korunması hakkının normatif alanını sınırlandırırken sunduğu güvencelerin hukuk devleti ilkesine uygun olarak keyfiliği önlemesi ve ölçülü olması gerekmektedir. Bu anlamda gözetleyen kurumları denetleyen mekanizmaların da demokratik ve etkili bir şekilde işletilmesi şarttır. Birleşik Krallık ve Türkiye’de gözetlemenin hukuksal çerçevesinin benzer, farklı ve eksik yönlerinin vurgulanacağı bu çalışma, terörle mücadele ve özel hayatın gizliliğinin korunması arasındaki kırılgan dengeyi sergilemektedir.
