Avrupa Birliği Hukukunda Savunma ve Güvenlik Alımları

Abstract

Savunma ve güvenlik alımları son yıllarda Avrupa Birliğinin AB gündeminde önemli bir yer tutmaktadır. AB’de savunma alımlarının önemli bir ekonomik rolü bulunmakta ve üye devletlerin savunma harcamaları yaklaşık olarak AB gayri safi milli hâsılasının yaklaşık yüzde ikisini teşkil etmektedir. Bu makalenin amacı, AB’de savunma ve güvenlik alımlarıyla ilgili yasal kuralların tartışılmasına imkân sağlamaktır. Üye ülkelerin 2009/81/AT sayılı savunma ve güvenlik alımlarıyla ilgili yönergeyi ulusal hukuka aktarmaları ve uygulamaları gerekmektedir. Bu nedenle bu makalenin önemli bir kısmı bu yeni yönergenin bir analizini teşkil etmektedir. Makalenin geri kalan diğer kısmı da AB savunma alımlarıyla ilgili tarihsel gelişmelerin bir özeti ve AB’nin İşleyişine Dair Antlaşmanın 346. maddesi bağlamında ‘üye devletlerin güvenlikle ilgili hayati çıkarları’ muafiyet uygulamasından oluşmaktadır

DEFENCE AND SECURITY PROCUREMENT UNDER THE EUROPEAN UNION LAW

Abstract

Defence and security procurement have featured prominently on the European Union EU agenda at recent years. Defence procurement plays an important economic role in the EU and defence expenditures of the Member States amounts to 2 per cent of the EU gross domestic product approximately. The purpose of this article is to provide a discussion of the legal rules governing defence and security procurement in the European Union Member States have to transpose into national laws and implement the new public procurement Directive on defence and security 2009/81/EC . Therefore, an analysis of the relevant provisions of the new Directive occupies the larger part of the article. The remainder provides an overview of historical developments of EU defence procurement and the implementation of ‘essential security interests of the Member States’ derogation under the article 346 of the Treaty on the Functioning of the European Union.
