Awarding Procedures and Bidding Implementations in Defence and Security Procurement

Abstract

In 2009, the European Union EU has introduced the EU Defence and Security Procurement Directive 2009/81/EC in order to foster the development of an EU defence equipment market by establishing a legal framework for cross-border defence procurement. This essay intends to emphasize that it is highly important to implement Directive 2009/81/EC fully and adequately in all Member States in order to create and liberalize a common defence market within the EU. It is certain that 2009/81/EC Directive constitutes a milestone in creating a common defence market by providing a framework for cross-border defence procurement in the EU. This paper seeks to analyse the most likely violated rules of the concerned Directive by the Member States. Accordingly, the main provisions of this Directive on contract award procedures will be explained and the other relevant provisions such as exclusion from the tendering process and offset implementations will be discussed

AB Savunma ve Güvenlik Alımlarında İhale Usulleri ve İhale Uygulamaları

Abstract

2009 yılında, Avrupa Birliği AB , sınır-aşırı savunma alımlarıyla ilgili yasal bir çerçeve oluşturarak AB savunma ekipmanları piyasasının gelişmesine yardımcı olmak amacıyla 2009/81/AT sayılı savunma ve güvenlik alımlarıyla ilgili yönergeyi kabul etmiştir. Bu makale, AB içerisinde ortak bir savunma piyasasını oluşturmak ve serbestleştirmek için 2009/81/AT sayılı yönergenin tam ve yeterli bir şekilde bütün üye devletlerde uygulanmasını sağlamanın son derece önemli olduğunu vurgulamak amacını taşımaktadır. Şu husus açıktır ki 2009/81/AT sayılı yönerge, AB içerisinde sınır-aşırı savunma ihaleleri yönünden yasal bir çerçeve oluşturarak ortak bir savunma piyasası oluşumu yönünden bir kilometre taşıdır. Bu makale üye devletlerin söz konusu yönergenin ihlal edilmesi kuvvetle muhtemel olan kurallarının analiz edilmesini amaçlamaktadır. Bu amaçla, yönergenin ihale usulleriyle ilgili temel hükümleri ve ihalede değerlendirme dışı bırakılma ile offset uygulamaları tartışılacaktır
