Avrupa Birliği’nde Vatandaşlık Temelinde Ayrımcılık Yasağı ve Birlik Öğrencilerinin Ekonomik Olarak Aktif Olmayan Üye Devlette Eğitimden Yararlanması

Abstract

Vatandaşlık gözetmeksizin eşit muamele hakkı, AB maddi hukukunun bahşettiği en önemli haklardan biridir. Vatandaşlık temelinde ayrımcılığın yasaklanması bütünleşmenin gelişmesi için gerekli ilk basamaktır. Avrupa bütünleşme süreci ile yakından bağlantılı ve onun için önemli diğer bir husus ise eğitimdir. Avrupa Birliği’nin İşleyişine Dair Antlaşma’nın ABİDA 18 1 .maddesi sadece, ABİDA’nın uygulama alanında vatandaşlık temelinde ayrımcılığı yasaklamaktadır. Divan içtihadı ise ABİDA’nın 18 1 .maddesinin uygulama alanını geniş yorumlamaktadır. Divanın ABİDA’nın 18 1 . maddesini geniş yorumlama hususundaki eğilimi, 1985 yılından itibaren verdiği Birlik vatandaşı öğrencilerin diğer üye devlette eğitimden yararlanmaları ile ilgili davalarla bağlantılı olarak gelişmiştir. Yapılan analiz, Divanın, ABİDA’nın 18 1 .maddesinin uygulama alanını, Kurucu Antlaşmaların eğitim ile ilgili hükümlerini kullanmak sureti ile genişlettiğini göstermektedir

CITIZENSHIP IN THE EUROPEAN UNION DISCRIMINATION BASIS AND ASSOCIATION STUDENTS ECONOMICALLY IN ACTIVE MEMBER STATE BENEFIT FROM EDUCATION

Abstract

The right to equal treatment irrespective of nationality is the most important right conferred by substantive European Union law. The prohibition of discrimination on grounds of nationality is the first essential step to promote integration. Education is important and closely linked to the European integration process. Article 18 1 TFEUprohibits discrimination only “within the scope of application of this Treaty”. The case law of the Court of Justice has interpreted those terms particularly broadly. The trend of the Court of Justice towards the broad interpretation of article 18 1 TFEU began in the 1985 and evolved by a line of cases pertaining to acces to education of Union students in other member states. The analysis demonstrates that the Court of Justice expanded the scope of the article 18 1 TFEU by the educational articles of the Founding Treaties.
