CİNSEL SALDIRI OLGULARININ SUÇ MOTİVASYONUNA GÖRE SINIFLANDIRILMASI

Abstract

Cinsel saldırı, bireyin fiziksel ve psikolojik bütünlüğünü bozan, en ağır şiddet suçlarından biridir. Cinsel saldırı vakaları ile ilgili yapılan çalışmalar göstermiştik ki bu durum, hem saldırganlık hem de cinsel dürtüler sonucunda ortaya çıkmaktadır. Cinsel saldırganların sınıflandırması; saldırının önlenmesi ve saldırganın yakalanması açısından kritik bir konudur. Cinsel saldırgan tipolojisinin ortaya konması, saldırganın davranışlarını anlamada, bir sonraki suç davranışını öngörmede ve onu yakalamada yardımcı olacak ve bunun geri dönüşü olarak, problemin gerçek boyutlarına ışık tutacaktır. Bu çalışma ile, cinsel saldırı davranışı ve motivasyonu incelenerek Türkiye’ye özgü sınıflandırma yapılması hedeflenmiştir. Araştırma, Marmara Bölgesi’nde yedi ayrı cezaevinde gerçekleştirilmiştir.Çalışmanın örneklemi bu cezaevlerinde bulunan ve cinsel saldırı suçundan hüküm giymiş 109 kişiden oluşmaktadır. Analizler; mağdurların, vakaların % 40.37’sinde (n:44) yetişkin ve % 59.63’ünde (n:65) çocuk olduğunu açığa çıkarmıştır. Vakaların % 70.64’ünde (n:77) mağdur ve saldırganın olay öncesinde tanışıklığı olduğu görülürken, % 29.36’sında (n:32) saldırgan yabancıdır. Cinsel saldırı vakalarının % 17.43’ü (n:19) ensest ilişkidir.
Yetişkine karşı işlenen cinsel saldırı vakalarının çoğunluğu (% 75 (n.33)) tanıdık saldırılarıdır. Çocuğa karşı işlenen cinsel saldırı vakalarında tanışıklık oranı ise % 67.69 (n:44)’dur. Yetişkine karşı işlenen saldırıların % 47.73’ünün güç kaynaklı olduğu gözlemlenmiştir. Bunun yanı sıra saldırıların % 9.09’unda sosyo-kültürel faktörlerin etkisi görülmektedir. Çocuklara yönelik cinsel saldırıların % 72.31’ini cinsel motivli
saldırılar oluşturmaktadır. Sonuç olarak, bu çalışma çocuğa ve yetişkine yönelik cinsel saldırıda bulunanlar arasında suç motivasyonu açısından farkları ortaya koymaktadır; çocuğa yönelik cinsel saldırıda bulunanlar çoğunlukla cinsel dürtü ile hareket ederken, yetişkin saldırılarında güç ve öfke ön plandadır. Bu çalışma ayrıca, kadına yönelik saldırıların cinsel bir davranışın ötesinde aslında cinselliği araç olarak kullanan bir şiddet suçu olduğunu da göstermektedir.
