Travma Sonrası Meydana Gelen Diş Avülsiyonunun Türk Ceza Kanununun 87. Maddesi Kapsamında Değerlendirilmesi: Olgu Sunumu

Abstract

Türk Ceza Kanununun 86. maddesinin gerekçesinde, kişinin vücuduna acı veren veya sağlığının ya da algılama yeteneğinin bozulmasına neden olan her davranış, yaralama olarak kabul edilmiştir. Türk Ceza Kanununun 87. madde metninde ise kasten yaralama suçunun neticesi sebebiyle ağırlaşmış hâlleri belirlenmiştir ki buna göre birinci fıkranın (a) bendinde, kasten yaralama suçunun mağdurun duyularından veya organlarından birinin işlevinin sürekli zayıflamasına neden olması, bu suçun neticesi sebebiyle ağırlaşmış hâli olarak öngörülmüştür.

“Türk Ceza Kanununda Tanımlanan Yaralama Suçlarının Adli Tıp Açısından Değerlendirilmesi Rehberi” kapsamında dişlerin çiğneme ve konuşma fonksiyonları yönünden değerlendirilmesinde, her bir diş çeşidi için puanlama yapılmış olup, kesici dişler için 4 puan, kanin dişler için 4,5 puan, premolar dişler için 3 puan, 1. ve 2. molar dişler için 3 puan ve 3. molar dişler için 0,5 puan verilmiştir. Diş kayıplarının puanlarının toplamı 15-30 arasında ise işlevin sürekli zayıflaması, 30’un üzerinde ise işlevin yitirilmesi olarak değerlendirilmektedir.

Dişin alveolar yuvasından çıkmasına avülsiyon denilmektedir. Tüm diş yaralanmalarının %0.5-3’ünde avülsiyon görülmekte olup bunların da tamamına yakınının travmalarla ilişkili olduğu bilinmektedir. Avülsiye olan dişin en kısa sürede replante edilmesi travmaya uğrayan dişin kayıp oranını azaltacaktır. Darp nedeniyle dört dişinde avülsiyon meydana gelen ve sonradan replantasyon uygulandığı için Türk Ceza Kanununun 87. maddesi 1(a) kapsamında değerlendirmediğimiz vakamızı sunduk.

Evaluation of Post Traumatic Tooth Avulsion within the Scope of Article 87 of the Turkish Penal Code: A Case Report

Abstract

Article 86 of the Turkish Penal Code defines injury as any behavior that causes physical harm to a person's body, deteriorates person's health or damages their ability to perceive. Accordingly, in section 1/a of Turkish Penal Code's Article 87, which defines the aggravated states of the crime of willful injury, it is predicted that the crime of willful injury causes the victim's function of one of his/her senses or organs to continuously deteriorate as the aggravated state resulting from this crime.

In the evaluation of teeth in terms of chewing and speech functions within the scope of the “Guide to Evaluation of Injury Crimes Defined in the Turkish Penal Code in terms of Forensic Medicine”, scoring was made for each tooth type, 4 points for incisors, 4.5 points for canines, 3 points for premolars, 3 points for first and second molars, and 0.5 points were given for the third molars. If total scores of tooth loss is between 15-30, it is considered as weakening of the function, and if it is above 30, it is considered as loss of function.

Avulsion is the term used to describe the tooth's protrusion from the alveolar socket. Avulsion is seen in 0.5-3% of all dental injuries, and it is known that almost all of them are related to trauma. The traumatized tooth's loss can be minimized by immediately replanting the avulsed tooth. We presented our case, which was not evaluated within the scope of Article 87/1(a) of the Turkish Penal Code, as four teeth were avulsed due to trauma and subsequently replanted.
