Devlet ormanlarına atık bırakılması ve çevre kirliliğine neden olunması konusunda, 6831 sayılı Orman Kanunu açık bir düzenleme içermemektedir. Konuyla ilgili olarak genel kanunlarda düzenlemeler olduğu görülmüştür. Başta Çevre Kanunu olmak üzere, Türk Ceza Kanunu ve Kabahatler Kanunu gibi genel kanunlarda hükümler bulunmaktadır. Özel kanunlarda hüküm olmaması halinde genel kanun hükümlerinin uygulanabileceği prensibi hem doktrinde hem de yargı kararlarında ortaya konmuştur. Ancak, orman idaresi ormanlarda kirletme fiiline karşı, genel kanun hükümlerini aktif bir şekilde uygulamaya koymamaktadır. Çalışmada devlet ormanlarına bırakılan atıklara dair hangi kanun hükümlerinin uygulanabileceği ve yüksek yargı organlarının da konuyla ilgili yaklaşımı ortaya konmaya çalışılmıştır. Cezayı uygulayacak mercilerin belirtildiği çalışmada fiil, suç ya da kabahat olarak ayrımı gözetilerek değerlendirilmiştir.
There is no clear regulation in the forest law No.6831 regarding to leave of the waste and environmental pollution in state forests. On the other hand, there are legal regulations in general laws on this subject. There are provisions in general laws such as the Environmental Law, the Turkish Penal Code and the Misdemeanor Law. The principle that the provisions of the general law can be applied in the absence of provisions in special laws has been revealed both in the doctrine and in the judicial decisions. However, the forest administration does not actively implement the provisions of the general law against the act of polluting the forests. In the study, it has been tried to reveal which law provisions can be applied regarding the wastes left in the state forests and the approach of the high judicial bodies on the subject. In which the authorities that will apply the punishment are also specified in the study, the act is evaluated by considering the distinction as a crime or misdemeanor.
