ADİL YARGILANMA HAKKI VE HUKUK DEVLETİ IŞIĞINDA “ŞİDDETE UĞRAMIŞ KADIN SENDROMU” ÜZERİNE BİR İNCELEME

Abstract

Şiddete uğramış kadın sendromu, kasıtlı ve tekrarlı bir şiddet döngüsüne maruz kalan kadının ruh hâlini, şiddetin ve bunun yol açtığı travmaların kadın üzerindeki psikolojik etkilerini ve şiddet gören kadının davranış kalıplarını açıklamak için geliştirilen psikolojik bir teoridir. Teori daha önce toplumsal cinsiyet ve ceza hukuku çalışmaları özelinde ele alınmış olsa da anayasa hukuku ve adil yargılanma hakkı bağlamında incelenmeyi de gerekli kılmaktadır. Çalışmanın çıkış noktası, kadının kendisine şiddet uygulayan partnerini öldürmesi nedeniyle yargılandığı hukuki uyuşmazlıklarda, maruz kalınan şiddet döngüsünün kadının karar alma mekanizmasını etkileyip etkilemediğinin değerlendirilmesinin ve buna ilişkin uzman görüşlerinin dikkate alınmasının adil yargılanma hakkının bir gereği olduğu düşüncesidir. Bu çerçevede, şiddete uğramış kadın sendromunun bir savunma delili olarak dikkate alınıp alınamayacağı tartışmasının hukuk devleti ve adil yargılanma hakkı özelinde ele alınması amaçlanmıştır. Toplumsal cinsiyet kavramı ve -özellikle ev-içi şiddete ilişkin normlar söz konusu olduğunda- hukukun toplumsal cinsiyet rollerini belirlemedeki gücü de bu kapsamda dikkate alınmıştır.
