On the Margins of Some of the Key Decisions of the Constitutional Court of the Republic of Kosovo

Abstract

As we shall see, none of these cases discussed here deal with the abstract control of constitutionality both preventive and repressive . The only one discussed has to do with the review of the constitutionality of the Statute of Municipality of Prizren, a city in the South of Kosovo bordering Albania, although a case was raised as an issue of equality of the citizens of Kosovo at the municipal level. In this case the Court did not tackle the issue of the constitutionality of the Statute itself. This does not mean, however, that the Court did not deal with issues of the abstract norm control of constitutionality.

Kosova Cumhuriyeti Anayasa Mahkemesi’nin Önemli Kararlarından Bazıları Hakkında Düşünceler

Abstract

Göreceğimiz üzere, burada tartışılan davaların hiçbiri anayasaya uygunluğun soyut denetimi ister önleyici denetim ister bastırıcı denetim olsun ile ilgili değildir. Kosova vatandaşlarının belediye düzeyinde eşitliği meselesiyle ilgili bir dava olarak ileri sürülmüş olduğu halde; anayasaya uygunluk denetimi kapsamında tartışılan tek konu, Kosova’nın güneyinde Arnavutluk’a komşu Prizren Belediyesi Tüzüğü’nün anayasaya uygunluğunun denetimi ile alakalıdır. Gerçi bu davada Mahkeme Tüzük’ün anayasaya uygunluğu meselesini ele almadı. Ancak bu, Anayasa Mahkemesi’nin soyut denetimle hiç ilgilenmediği anlamına gelmemektedir.
