Avrupa Ombudsmanlarının İncinebilir Gruplara Yaklaşımları

The organisation of special protection units for the rights of vulnerable groups is regulated in the Paris Principles. In this respect, it is observed that special units for the protection of the rights of vulnerable groups have been established in European ombudsman institutions. Firstly, it is necessary to mention child rights units, which are the most common of the special units. Second, national preventive mechanisms scrutinise the rights of vulnerable groups. In addition to these, it is observed that special units have been established according to the problems of the countries. A special unit of the veterans' ombudsman has been established to examine the complaints of injured members of the Dutch national security and peacekeeping missions. In Austria, the Austrian ombudsman has been entrusted with the task of redressing the victimisation caused by violence and abuse of persons who were accommodated in public institutions during their childhood. In order to protect and promote human rights, the creation of a special unit in independent human rights institutions for violations of the rights of vulnerable groups in society is beneficial for the functioning of the institution and the protection and promotion of rights.

İncinebilir grupların haklarına dair özel koruma birimlerinin oluşturulabileceği Paris Prensiplerinde düzenlenmiştir. Bu itibarla Avrupa’da bulunan ombudsman kurumlarında incinebilir grupların haklarının korunmasına dair özel çalışma birimleri ihdas edilmiştir. İlk olarak özel birimlerden en yaygını olan çocuk hakları birimlerine değinmek gerekir. İkinci olarak, ombudsman kurumlarının teşkilatı içerisinde bulunan ulusal önleme mekanizmaları incinebilir grupların haklarına dair şikâyetleri incelemekte, raporlama faaliyeti yürütmektedir. Bunlarla birlikte ülkelerin sorunlarına göre özel birimlerin ihdas edildiği de görülmektedir. Hollanda’da ülke güvenliği ve barış gücü misyonunda görev alan askerlerden yaralananların şikâyetlerini incelemek için gazi ombudsmanlığı özel birimi kurulmuştur. Avusturya’da ise çocukluklarında kamu kurumları bünyesinde barınan kişilerin şiddet ve istismara uğramaları sebebiyle oluşan mağduriyetin telafi edilmesinde Avusturya Ombudsmanına görev verilmiştir. İnsan haklarının korunması ve geliştirilmesi için toplumdaki incinebilir grupların hak ihlallerine dair bağımsız insan hakları kurumlarında özel birim ihdası, kurumun işlerliği ve hakların korunup geliştirilmesinde fayda sağlamaktadır.
