Abstract

This article provides a comparative and critical assessment of personal data protection issues faced by vulnerable groups such as migrant women, children, the elderly, and persons with disabilities in the context of Turkey and the European Union. The collection and processing of data through digital systems is not merely a technical issue, but a structural privacy problem affecting the entire migrant population, regardless of legal status. The article examines the specific challenges faced by vulnerable groups under digital surveillance and proposes rights-based legal and policy solutions. While the EU’s GDPR offers a theoretically robust protection framework, systems such as EURODAC and broad public security exceptions pose significant risks to vulnerable groups. In Turkey, although the Constitution, the Personal Data Protection Law (KVKK), the Law on Foreigners and International Protection (YUKK), and its implementing regulation offer certain safeguards, a comprehensive and justice-based protection regime has yet to be established.

Göçmenlerin Kişisel Veri Hakları: Türkiye ve AB’de Kırılgan Göçmen Gruplar Açısından Veri Koruma Sorunu

Abstract

Bu çalışma, dijital çağda göçmen kadınlar, çocuklar, yaşlılar ve engelliler gibi kırılgan grupların kişisel verilerinin korunmasına ilişkin sorunları, Türkiye ve Avrupa Birliği örneğinde karşılaştırmalı ve eleştirel bir yaklaşımla incelemektedir. Dijital sistemler aracılığıyla veri toplanması ve işlenmesi, teknik bir sürecin ötesinde, hukuki statüsü ne olursa olsun tüm göçmen grupları ilgilendiren bir mahremiyet sorunu teşkil etmektedir. Çalışmada, dijital gözetim uygu-lamaları karşısında kırılgan grupların karşılaştığı özel güçlükler değerlendirilmekte ve veri güvenliği, mahremiyet ve rıza ilkelerine dayanan çözüm önerileri sunulmaktadır. Avrupa Birliği’nde GDPR teorik olarak kapsamlı koruma mekanizmaları sunsa da, EURODAC sistemi ve güvenlik istisnaları kırılgan gruplar açısından çeşitli riskler doğurmaktadır. Türkiye’de ise Kişisel Verilerin Korunması Kanunu, Yabancılar ve Uluslararası Koruma Kanunu ve Uygulama Yönetmeliği ile belli güvenceler sağlanmakla birlikte mevcut durumda sistemsel olarak göçmenlerin ihtiyaçlarını gözeten bütüncül bir koruma yaklaşımının henüz oluşturulamadığı ifade edilebilir.
