Egemenlik ve Evrensel Yargı Yetkisi İlişkisinin Uluslararası Ceza Hukuku Boyutu

The perpetrators of some crimes that disrupt the international order may need to be tried where they are found. In our study the universal jurisdiction which forms the basis for the prosecution of international crimes in terms of the effect it has left will be analyzed. In this context, the basis of limiting the sovereign power of the state will be explained. In particular, the importance of the norms, which are defined as jus cogens norms and from which the customary law originates, will be revealed in terms of the use of universal jurisdiction. Universal jurisdiction, where jurisdiction is committed, the victim is likely to be close and likely to fail. In this respect, universal jurisdiction naturally imposes some limitations on the internal sovereignty of the country where the perpetrator is a citizen and the state where the crime was committed.

Uluslararası düzeni bozan kimi suçların faillerinin bulundukları yerde yargılanmaları gerekebilir. Çalışmamızda, bırakmış olduğu etki bakımından uluslararası suçların yargılanabilmesine dayanak oluşturan evrensel yargı yetkisinin ne olduğu izah edilecektir. Bu bağlamda devletin sahip olduğu egemenlik yetkisinin sınırlandırılabilmesinin dayanak noktaları açıklanacaktır. Bilhassa jus cogens norm olarak nitelendirilen ve örf ve âdet hukukunun da kaynağını oluşturduğu normların evrensel yargı yetkisinin kullanılabilmesi bakımından önemi ortaya konulacaktır. Evrensel yargı yetkisi, devletin suçun işlendiği yere, mağdurun ve failin vatandaşlığına bakılmaksızın yargılama bakımından yetkili olması anlamına gelmektedir. Bu bakımdan evrensel yargı yetkisi, suçu işleyen failin vatandaşı olduğu ülkenin ve suçun işlendiği yerdeki devletin iç egemenliğine doğal olarak birtakım sınırlandırmalar getirmektedir.
