Abstract
Avrupa İnsan Hakları Mahkemesinde (AİHM) 25701/94 başvuru numarasıyla görülen Eski Yunanistan Kralı ve Diğerleri v. Yunanistan Davası 23 Kasım 2000’de Büyük Dairenin kararı ile neticelenmiştir. Bu metin bahsi geçen kararın İngilizce metninden yapılan çevirisidir. Eski Yunanistan Kralı Davası Avrupa İnsan Hakları Sözleşmesi’ne (AİHS) Ek 1 No.lu Protokol’ün 1. maddesi ile garanti altına alınmış olan mülkiyet hakkının ihlal edip edilmediğinin denetlendiği davalardan biridir. Davanın temelinde, eski Yunanistan Kralı ve ailesinin sekiz üyesinin, Yunanistan aleyhine Mahkemeye yapmış oldukları başvuru bulunmaktadır. Başvuranlar, 1994 yılında Yunanistan Meclisi tarafından kabul edilip yürürlüğe girmiş olan bir kanunla, kendilerine ait taşınır ve taşınmaz bazı mallarının herhangi bir tazminat verilmeksizin kamulaştırılmasına ve Yunan Devleti’nin mülkü sayılmasına karşı çıkarak AİHS’de düzenlenen haklarının ihlal edildiğini iddia etmişlerdir. Davayı inceleyen Mahkeme, başvuranların alınan mülklerine mukabil olarak Yunan Devletince telafi edici tazminat sağlanması yönünde meşru bir beklentiye sahip olduklarını vurgularken Yunan makamlarının neden başvuranların mülklerini almak için herhangi bir tazminat vermediğine dair ikna edici bir açıklama getiremediğini ifade etmiştir. Dolayısıyla başvurucuların malları üzerinde serbestçe tasarrufta bulunma hakkına müdahale edildiğine, başvurucuların mülklerinden mahrum bırakılmasıyla zarar gördüğüne ve mülkiyetin korunması ile kamu yararı arasındaki adil dengenin kurulamadığına kanaat getiren Mahkeme, AİHS’e ek 1 No.lu Protokol’ün 1. maddesinin ihlal edildiğine hükmetmiştir.
Abstract
The Case of the Former King of Greece and Others v. Greece before the European Court of Human Rights (Application No. 25701/94) was finalized by the Grand Chamber judgment delivered on the 23rd of November 2000. The presented manuscript is a translation of the judgment from the English text. The Case of the Former King of Greece is one of those cases in which the Court reviews whether the property right guaranteed by Article 1 of Protocol No. 1 of the European Convention on Human Rights (ECHR) have been violated. The case is based on the application made to the Court against Greece by the former King of Greece and eight members of his family. The applicants alleged that their rights under the ECHR had been violated by the expropriation of some of their movable and immovable properties without any compensation and the recognition of them as the property of the Greek State, by a law passed by the Greek Parliament and entered into force in 1994. The Court, examining the case, emphasized that the applicants had a legitimate expectation of compensation by the Greek Government in return for their property taken, while stating that the Government had failed to provide a convincing explanation as to why the Greek authorities had not given any compensation for taking the applicants’ property. Therefore, the applicants’ right to dispose of their property was interfered with and the applicants were injured by the deprivation of their property, and that a fair balance between the protection of property and the public interest could not be established. Finally, the Court concluded that there had been a violation of Article 1 of Protocol No. 1 of the ECHR.
