Cezalandırma ve Acı İlişkisi

Abstract

Cezalandırma kavramı hoş olmayan muamele, sert muamele, elem, acı, ıstırap, olduğundan kötü hale düşme gibi anlamlara karşılık gelir. Cezalandırmada acı önemli bir unsurdur. Acı psikolojik, nörolojik, fiziki öznel deneyimler içeren kompleks bir yapıdadır. Cezalandırmada hedeflenen amaçlara ulaşmak için acı bir araçtır. Bireysel farklılıklar acının farklı şekillerde algılanmasına ya da hiç hissedilmemesine sebep olabilir. Bu durum toplum tarafından cezalandırmanın adaletsiz bulunmasına yol açabilmektedir. Ancak esas olan otoritenin hedeflediği ceza ve bu kapsamda beklediği acıdır. Otoritenin istediği cezalandırmanın gerçekleşmesi halinde beklenen acı ve ıstırabın faile yansıması şart değildir. Acı önemli bir unsurdur ancak istisna olarak eksikliği cezalandırmanın varlığını ortadan kaldırmaz. Cezalandırma ve acı ilişkisi konusunda önemli bir boşluk vardır. Bu çalışma ile acı ve cezalandırma ilişkisindeki sorunlar ve tartışmalar incelenerek literatüre katkıda bulunmak amaçlanmaktadır.

Punishment and Pain Relationship

Abstract

Punishment involves harsh or unpleasant treatment that causes pain, suffering, or deterioration. Pain is an essential element in punishment. Pain is a complex structure that includes psychological, neurological, and physical subjective experiences. Pain is a tool to achieve the targeted goals in punishment. Pain perception varies among individuals, and some may not feel it at all. This situation may lead to society finding punishment unjust. However, what is essential is the punishment that the authority targets and the pain it expects within this scope. If the authority's intended punishment is achieved, the expected pain and suffering need not affect the perpetrator. Pain is a significant component, but its absence as an exception does not negate the existence of punishment. There is a significant gap in the relationship between punishment and pain. This study aims to contribute to literature by examining the problems and discussions in the relationship between pain and punishment.
