Çek Cumhuriyeti Hükümet Sistemi Üzerine Bir İnceleme

Abstract

Çek Cumhuriyeti’nde 2012 yılında gerçekleştirilen anayasa değişikliği ile Cumhurbaşkanı halk tarafından seçilmeye başlanmıştır. Bu çalışmada, söz konusu anayasa değişikliği sonrası ortaya çıkan hükümet sistemindeki dönüşüm analiz edilerek Çek Cumhuriyeti hükümet sistemi tarihsel ve anayasal bağlamda incelenmiştir. 1993 yılında, Çekoslovakya’nın barışçıl bir biçimde dağılmasından sonra Çek Cumhuriyeti kurulmuş ve hükümet sistemi olarak da parlamenter hükümet sistemi benimsenmiştir. Ancak, cumhurbaşkanını halkın seçmesi ile birlikte ülkenin hükümet sisteminde önemli bir kırılma yaşanmıştır. Bu değişiklik, cumhurbaşkanının anayasal yetkilerine dokunmamış olsa da halk tarafından seçilmesiyle birlikte doğrudan meşruiyete sahip olan cumhurbaşkanı fiilen daha güçlü ve etkin bir siyasi aktör haline gelmiştir. Çalışmada, anayasal organların yetki dağılımı ve uygulamada yaşanan örnekler çerçevesinde yasama ve yürütme organları arasındaki ilişkiler incelemiştir.

A Study On the Government System of the Czech Republic

Abstract

With the constitutional amendment made in 2012 in the Czech Republic, the President began to be elected by the people. In this study, the transformation in the government system that emerged after the constitutional amendment was analyzed, and the government system of the Czech Republic was examined in a historical and constitutional context. In 1993, after the peaceful dissolution of Czechoslovakia, the Czech Republic was established, and the parliamentary system of government was adopted. However, with the election of the president by the public, there was a significant break in the country's government system. Although this change did not touch the constitutional powers of the president, the president, who had direct legitimacy by being elected by the people, became a more powerful and effective political actor. In the study, the relations between the legislative and executive bodies were examined within the framework of the distribution of powers of the constitutional bodies and the examples experienced in practice.
