Abstract

ÖZET
Bu çalısmada commenda ve mudarabe ortaklıklarının ticaret
hukuku tarihi açısından farklı cografyalarda ortaya çıkısı, gelisimi ve
etkilesimini ele aldık. Temelde bu iki ortaklık çesidinin yapısal
özelliklerini ve isleyislerini inceledigimizde bunların çok farklı
olmadıgı hatta ayrı isimlerle ifade edilen tek bir ortaklık oldugu
kanaatine vardık. Çünkü her toplumun ekonomik ve ticari hayatındaki
uygulamaları, kendi inanç ve düsüncelerinin etkisiyle sekillenmistir.
Zira Hıristiyanlık ve Müslümanlık’ta faizle para alıp vermenin yasak
olması bu tür alternatiflerin ortaya çıkmasına imkan vermistir. Çünkü
sermaye sahiplerinin finansal varlıklarını artırabilmelerinin yolu
ellerindeki sermayelerini kar getirebilecek sekilde isletmelerine
baglıdır. Rizikoyu her zaman bulundurmakla birlikte bunun da en
pratik yolu sermaye sahiplerinin paralarını bir ortak aracılıgıyla
islettirmeleridir.
Commenda ve mudarabe ortaklıkları temelde insanlıgın ortak
olgularıdır. Zira farklı isleyis ve muhtevalarıyla bu ortaklıkları ayrı
isimler altında uygarlıkların ticaret hayatında görmekteyiz. Herhangi
bir toplumun ekonomik ve ticari hayatındaki kurum ve müesseseler
digerlerinden çok farklı degillerdir. Binaenaleyh medeniyetler ve
kültürler arası kaçınılmaz olan etkilesimin ürünleri ticari ve ekonomik
hayatta da kendini göstermektedir. Yalnız her toplumun kendi inanç ve
felsefesinin tezahürünü ekonomiden ticarete, siyasetten kültüre ve
sanata kadar her alanda görmek tabii ve mümkündür

ABSTRACT

In this study, we handled the occurance, development and
interaction of mudarabe and commenda partnerships in different
locations in terms of Commercial Law Hıstory. In fact we concluded
that these two partnerships were not different from each other, even
they were the same partnership called under two different names
concerning the structural and operational features. Becauce
economical and commercial life practices of every society have been
formed by its own beliefs and thoughts. Since both Christianity and
Islam prohibited to lend and borrow money at interest this kind of
partnership has come up as an alternative way out. The way for the
investor to increase their financial wealth is invest their capital in
profitably. Although it has risk, the most practical way for the investor
to profit is to invest their money through joining in a partnership.
Commenda and Mudarabe partnerships are essentially common
phenomeno of humanity. Because we witness these partnerships
having different implementation and content under different names in
commercial life of civilizations. Commercial establishments in
economical and commercial life of any society are not so different
from others. Therefore production of interaction between cultures and
civilization whic are inevitable come out in commercial and
economical life too. But it is quite natural and possible to see every
society’s own belief and philosophy in every field-from economic to
commerce, from polities to art and culture.
