Post-Mortem Cesarean Section

Abstract

This paper presents the first reported case in Turkey of a successful post-mortem cesarean section resulting in the live birth of a neonate. The case is analyzed in conjunction with a review of the medical and legal aspects surrounding this rare procedure. While the global literature includes only a limited number of such successful interventions, timely action is critical in preserving fetal life following sudden maternal death. In the presented case, a 35-year-old woman with tuberculous meningitis underwent post-mortem cesarean section six minutes after confirmed death, resulting in the delivery of a live female infant weighing 3000 grams. Literature review indicates that fetuses older than 28 weeks have the highest survival rates when delivery occurs within 10 minutes after maternal death. Legally, the status of post-mortem cesarean varies significantly across jurisdictions; currently, no specific legal framework addresses this issue in Turkey. The study argues that physicians have a moral and medical obligation to act swiftly in such cases and calls for formal legal clarification on the matter.

Post - Mortem Sezaryen

Abstract

Bu çalışmada, Türkiye’de ilk kez post-mortem sezaryen operasyonu ile başarılı şekilde canlı bebek doğurtulan bir klinik vaka sunulmakta ve bu nadir durumun tıbbi ve hukuki yönleri kapsamlı şekilde değerlendirilmektedir. Literatürde bildirilen başarılı post-mortem sezaryen olgularının sayısı sınırlı olmakla birlikte, annenin ani ölümü sonrasında fetusun yaşamını sürdürebilmesi için bu cerrahi müdahalenin zamanında uygulanması büyük önem taşımaktadır. Sunulan olguda, tuberküloz menenjit nedeniyle ölen 35 yaşındaki gebenin ölümünden 6 dakika sonra yapılan sezaryen sonucunda 3000 gram ağırlığında, canlı bir kız bebek başarıyla doğurtulmuş ve sağlıklı şekilde taburcu edilmiştir. Literatür analizi, 28. gebelik haftasından büyük fetuslarda, ölüm sonrası ilk 10 dakikada yapılan müdahalelerin yüksek başarı oranına sahip olduğunu ortaya koymaktadır. Ayrıca, farklı ülkelerde bu operasyonun hukuki konumu değişkenlik göstermekte olup, ülkemizde henüz açık bir düzenleme bulunmamaktadır. Çalışma, hekimlerin böyle bir durumda tereddüt etmeden insani ve tıbbi yükümlülüklerini yerine getirmesi gerektiğini savunmakta, bu konuda yasal düzenlemelere ihtiyaç olduğunu vurgulamaktadır.
