Uluslararası Diplomasi Hukuku ve Doktorlar: Kısa Bir Tahlil

Abstract

Uluslararası hukuk her zamankinden daha karmaşık olarak mütenevvi yaklaşımı zarurî kılmaktadır. Bu bağlamda, belirli durumlar çerçevesinde uluslararası hukuk birçok bilim dalıyla bağlantılandırılabilir. Her ne kadar bu bağlantı sınırlı olsa da tıp bu alanlardan biridir. Silâhlı çatışmalardaki doktorların, daha kesin bir ifadeyle tıbbî personel özel bir korumaya ilişkin belirli düzenlemelere sahiptir. Diğer bir alan ise, uluslararası hukukta sağlığın genel olarak düzenlenmesidir. Böylece, burada temel ilgi Dünya Sağlık Örgütü’ndedir. Ancak, gerçek ve sınırlı anlamında diplomasi ne durumdadır? Bir doktor, gerek diplomatik, gerek başka bir biçimde misyon personeline dâhil edilebilir mi? Eğer cevap olumluysa, bunun sonuçları ne olacaktır? Bu çalışmada, tüm bu soruların cevapları kısaca araştırılacaktır

International Law of Diplomacy and Physicians: A Short Analysis

Abstract

International law, as complicated as ever, requires diversified approach. In this respect, under certain circumstances many scientific fields could be associated with international law. Although its association is limited, medicine is among those fields. The situation of physicians, or medical professionals to be exact, at armed conflicts have particular regulations relating to a specific protection. The other field would be the general regulation of health in international law. Henceforth with, the WHO is the main concern as such. But, what about diplomacy in its real and restricted meaning? Could a physician be included in the mission as a personnel either diplomatic or otherwise? If the answer is affirmative, then what would be the consequences? In this essay, all the answers of these questions will briefly be analyzed.
