The Place and Importance of Roman Jurists in the First Empire Period

Abstract

The period in which Roman jurisprudence reached its highest level was the period of the First Empire. In this period, which is called classical law, lawyers caused themselves accepted as real legal geniuses with their activities. The fact that first Augustus and then Hadrianus provided privileges to lawyers the science of law carried to more advanced levels. However, since Augustus, on the one hand, law has been accepted as a product of political authority on the other hand, it has emerged as a field in which lawyers have made important contributions to its changes with their views. An outline of why and how jurists were valued by the dominant political authority during the First Empire period is the subject of this article. This article aims to reveal if the value given to the jurists by the political authorities increases, the Roman legal science will continue to its development at the same rate and jump to the advanced level.

İlk İmparatorluk Döneminde Roma Hukukçularının Yeri ve Önemi

Abstract

Roma hukuk ilminin en yüksek seviyeye ulaştığı dönem, İlk İmparatorluk dönemidir. Klasik Hukuk olarak adlandırılan bu dönemde hukukçular, faaliyetleri ile gerçek hukuk dâhileri olarak kendilerini kabul ettirmişlerdir. Önce Augustus’un, daha sonra Hadrianus’un hukukçulara imtiyaz sağlaması ise hukuk bilimini daha ileri seviyelere taşımıştır. Ancak hukuk, Augustus’tan itibaren bir taraftan siyasi otoritenin bir ürünü olarak kabul edilirken, diğer taraftan hukukçuların görüşleri ile değişimine önemli katkılar sağladığı bir alan olarak karşımıza çıkmıştır. İlk İmparatorluk döneminde hukukçuların baskın siyasi otorite tarafından neden ve nasıl değer gördüğünün ana hatları ile açıklanması bu çalışmanın konusudur. Bu çalışma, siyasi otoritelerin hukukçulara verdiği değer arttıkça, Roma hukuk biliminin de aynı oranda gelişimini sürdürerek ileri seviyeye taşınacağını ortaya koymayı amaçlamaktadır.
