An Analysis of Sport Management and Administrative Control in Ombudsman Decisions

Abstract

Purpose: The purpose of this study is to examine the decisions of the Ombudsman Institution of Türkiye concerning sport within the relationship between sport management, public administration and administrative control. The study analyses the administrative problem areas reflected in sport-related decisions, the legal and managerial principles considered by the Institution, and the control function that recommendation decisions may perform in sport management.

Method: The study was designed as a qualitative case study. The research data were obtained from publicly accessible decisions in the Institution’s Decisions Database. Eight decisions directly related to sport management were included in the study. The data were analyzed through document analysis and directed content analysis.

Results: Four main themes were identified: coaching certificates and qualification procedures; athlete transfer and club-related procedures; school sports and competition processes; and arbitration, refereeing and reasoned decision-making. The findings indicate that sport-related disputes mainly concern documentation, the right to apply, the exercise of discretionary power, reasoning, equality, transparency and administrative procedure.

Conclusion: The findings show that sport management has a clear public administration dimension, since many disputes arise from administrative acts and practices carried out by federations, provincial directorates, educational institutions and other public bodies. Although the decisions of the Ombudsman Institution are not legally binding, they may serve as a relevant source for examining administrative control in sport management and for tracing the practical meaning of good administration principles.
