İklim Mültecilerinin Hukuki Statüsü Meselesi: Deniz Seviyesinin Yükselmesi ve Ada Ülkelerinde Yaşayanların Durumu

Abstract

Bu çalışmada iklim değişikliği sebebiyle göç etmek zorunda kalmış kişilere uluslararası koruma tanınıp tanınmayacağı ve eğer tanınacaksa bu korumanın statüsünün ne olacağı tartışılmıştır. Bu hususta son yıllarda özellikle ada ülkelerinde yaşayan ve deniz seviyesinin yükselmesi ile hayat kalitesi düşen, hatta vatansız kalma riskiyle karşı karşıya kalan kişilerin durumu ön plana çıkmaktadır. Bu tartışma oldukça yeni bir tartışma konusu olduğundan alana dair literatürün de oluşum içinde olduğu söylenebilir, zira iklim değişikliği kaynaklı göçe maruz kalanların hukuki statüsü henüz bir netlik kazanmamıştır. Bu çalışmada öncelikle konu ile ilgili mevzuat ve kavramsal çerçeve incelenerek iklim mültecisi kavramının statüsü hakkındaki literatüre dair bir çerçeveçizilecektir. 1951 tarihli Mültecilerin Hukuki Statüsüne Dair Cenevre Sözleşmesi ve 1967 tarihli Protokolü ile İnsan Hakları Evrensel Beyannamesinde yapılan düzenlemelerle geliştirilen uluslararası koruma genel anlamda mültecilik ve tamamlayıcı korumayı kapsamaktadır. Ayrıca statüsü bireysel olarak belirlenemeyecek kadar çok sayıda kişinin göç etmesi durumlarında geçici ve acil koruma sağlanabilmesi için geçici koruma kavramı ortaya çıkarılmıştır. Uluslararası hukuk kaynaklarında iklim değişikliği nedeniyle göç eden kişileri koruyacak kapsamlı bir düzenleme bulunmamaktadır. Ancak sanayi üretiminin artması ve fosil yakıt tüketimi gibi gerekçelerden dolayı artan küresel ısınma deniz seviyesinin yükselmesine neden olmakta ve özellikle ada devletlerinde yaşayan insanların hayatını olumsuz etkilemektedir. İklim değişikliğinden kaynaklanan sebeplerden dolayı göç etmek zorunda kalanların ya da gelecekte deniz seviyesinin yükselmesi nedeniyle ada devletlerinin su altında kalmasından dolayı meydana gelecek zorunlu göçlerin bu kapsama girip girmediği son zamanlarda giderek artan şekilde gündeme gelen bir tartışmadır.

The Matter of The Legal Status of the Climate Refugees: Sea Level Rise and Situation of Those Who Live in Island States

Abstract

This study discusses the recognition and the status of international protection of the individuals forced to migrate due to climate change. Since this discussion is relatively up to date, the literature on the field is still in the evolving process as the legal status of those affected by climate-based migration has not been clearly defined yet. The situation of people living in areas affected by rising sea levels has become an especially current topic in the recent years. Their quality of life has declined, and they are even at risk of becoming stateless. In this study, firstly the legislation and conceptual framework related to the topic will be examined, and a framework will be drawn from the literature regarding the status of the concept of climate refugees. The 1951 Geneva Convention relating to the Status of Refugees and its 1967 Protocol, as well as the provisions in the Universal Declaration of Human Rights generally covers the protection of refugees and complementary protection. Additionally, the concept of temporary protection has been introduced for situations where the number of migrants is too large and thereforeindividual status determination process becomes nearly impossible. Today there is no comprehensive regulation in international law specifically protecting climate change migrants. However, the increase in global warming due to factors such as industry and fossil fuels leads to sea level rise and effect especially those who live in island states. The question whether those forced to migrate due to the effects of climate change or the future forced migrations due to the submersion of island states as a result of rising sea levels fall under the international protection under any current binding international document has become an increasingly discussed topic.
