Abstract

The work evaluates the claim that the rules established by the existing body of Islamic jurisprudence (fiqh) are insufficient for regulating contemporary social life, and that this issue can only be resolved by returning to the sources of Islam to develop a new discipline of fiqh. The author identifies the root of this perception and its causes, arguing that the problem does not stem from a deficiency in the current science of fiqh, but rather from the political weakening of Muslims throughout history and the resulting social and cultural degeneration. According to the author, the issue raised and debated concerning Islamic law is not related to the insufficiency of the fiqh tradition. The matter is that the rules of Islamic law, which found their foundation in a specific political and sociological context during the historical process, have lost their grounding due to the political and social decline of Muslims.

Abstract

Eserde mevcut fıkıh birikiminin ortaya koyduğu kuralların günümüzde, toplumsal hayatı düzenlemede yetersiz kaldığı ve bunun da ancak Dinin asıl kaynaklarına dönerek yeniden bir fıkıh ilmi ortaya koymakla aşılabileceği iddiası değerlendirilmektedir. Yazar söz konusu algının asıl kaynağını ve sebeplerini ortaya koyarak sorunun mevcut fıkıh ilmindeki yetersizlikten değil, tarihsel süreçte Müslümanların siyasi yönden zayıflaması ve bunun sonucunda ortaya çıkan sosyal ve kültürel dejenerasyondan kaynaklandığını ortaya koymaktadır. Bu bakımdan yazara göre İslam hukuku ile ilgili olarak ortaya atılan ve tartışması yapılan problem fıkhî birikimin yetersizliği ile ilgili değildir. Mesele tarihsel süreçte siyasi ve sosyolojik zeminini bulan İslam hukuku kurallarının Müslümanların siyasi ve sosyal yönden gerilemesiyle bu zemini kaybetmesidir.
