Ulusal Mevzuatta Çocuk Haklarının Gündemleştirilmesi

Abstract

Bu çalışma, Türkiye’nin çocuk hakları gündeminin stratejik belgeler ve ulusal mevzuat aracılığıyla nasıl şekillendiğini tartışmayı amaçlamaktadır. Çalışmanın temelinde, Türkiye’nin 2023–2028 Çocuk Hakları Strateji Belgesi ve Eylem Planı ile çocuk haklarıyla ilişkilendirilen 27 ulusal yasal düzenlemenin içerik analizi yer almaktadır. Türkiye'nin çocuk hakları politikalarının evrensel normlarla nasıl örtüştüğü ve yerel dinamikler ışığında nasıl şekillendiği değerlendirilmiştir. Çocuk hakları, yalnızca hukuki normlarla değil, kültürel, sosyal ve ekonomik bağlamda da yeniden ele alınmış, yerel ihtiyaçlara göre esnek bir çocuk hakları politikası gerekliliği vurgulanmıştır. Ayrıca, Türkiye'deki toplumsal normların, çocukların hak temelli bir özne olarak kabul edilmesini sınırladığı ve bunun çocuk hakları politikalarını nasıl etkilediği tartışılmıştır. Çalışma, çocuk hakları söyleminin Türk hukuk sistemine ne ölçüde dahil edilebileceğini ve sivil toplumun bu alandaki rolünü ele almıştır.

Agenda Setting of Children's Rights in National Legislation

Abstract

This study aims to explore how Turkey’s child rights agenda has been shaped through strategic documents and national legislation. The core of the study involves a content analysis of Turkey’s 2023–2028 Child Rights Strategy Document and Action Plan, alongside 27 national legal regulations related to child rights. The study evaluates how Turkey’s child rights policies align with universal norms and how they are shaped in light of local dynamics. Child rights have been re-examined not only through legal norms but also within cultural, social, and economic contexts, emphasizing the need for a flexible child rights policy that addresses local needs. Additionally, the study discusses how societal norms in Turkey limit the recognition of children as rights-bearing subjects, and how this affects child rights policies. The study also addresses the extent to which child rights discourse can be incorporated into the Turkish legal system and the role of civil society in this area.
