Designation of the actual will of the legatorin deceased collusion in accordance with supreme court case law
Abstract
It was emphasized that the actual will of the legator shall be
investigated deeply in order to specify deceased collusion in accordance with
the established Supreme Court Case Law, because the supreme court relates the
existence of deceased collusion with the legator’s “intention of property
abduction from the inheritor” in the collusion. When detecting the actual will
of the legator The Supreme Court considers the facts as traditions of the
country and region, inclinations of the society, usual flow of events, whether
the legator has valid and reasonable cause to conclude a contract, whether the
defendant has purchasing power, the price gap between the sales price and the
actual value on the contract date and human relations between the parties and
the legator.
