Abstract
Reemployment
Lawsuit is a recourse for the worker, who is
removed from the job by the employer without a valid termination reason. Reemployment
Lawsuit is a lawsuit, which allows the worker to
provide job security and to compensate for any damages that he/she has suffered
in times of inactivity.
Reemployment Lawsuit
also serves for the purpose of regulating the labor law in order to ensure the
protection of workers. The Reemployment Lawsuit restricts the employer's right
to termination.
In order for the worker to be able to open the Reemployment
Lawsuit, he must first apply to the mediator. If the parties agree on the
mediation, the dispute is decisively resolved. If the parties cannot agree on
the mediation, worker must apply for a work court action within the period and
open the Reemployment Lawsuit. The Reemployment Lawsuit is subject to simple
judicial procedure. The parties may prove their claims under any general
provisions.
