CLIMATE JUSTICE AND CHILDREN’S RIGHTS

Abstract

The atmosphere is warming due to increasing greenhouse gases and this causes the climate to change. With climate change, some natural disasters such as increase in air temperatures, rise in water level, forest fires, drought and food crisis are increasing day by day. Increasing natural disasters and changing climatic conditions have caused
climate change to be called climate crisis. Today, the climate crisis deeply affects the whole world and makes living conditions difficult. Disadvantaged groups, including women, children and disabled people, are most affected by the negative consequences of the climate crisis.
The concept of climate justice; It examines how the disadvantaged groups listed above do not contribute to climate change, but suffer more from its negative consequences. Children, who are among the most vulnerable groups and are dependent on their families, are also negatively affected by the climate crisis. Past generations consume natural resources and release greenhouse gases into the atmosphere without caring about subsequent generations; It has left today’s children and future generations with an uninhabitable climate and increasingly difficult living conditions.
Children’s rights, which are protected in international documents and our Constitution, are affected in every aspect due to the climate crisis and climate injustice. States, on the other hand, have an obligation to prevent the effects of climate change and to prevent disadvantaged or vulnerable groups from falling into a worse situation. In this context, states need to take some actions for children who need to be protected.
In the study, after defining the concepts of climate crisis, climate justice and children’s rights, children’s rights protected in national and international law are listed and the aspects in which these rights are affected due to the climate crisis are stated. In addition, international applications, especially to the European Court of Human Rights and the United Nations, were examined, and finally, suggestions were made to prevent children’s rights from being affected even worse in the long term.

İKLİM ADALETİ VE ÇOCUK HAKLARI

Abstract

Artan sera gazları sebebiyle atmosfer ısınmakta ve bu iklimin değişmesine sebep olmaktadır. İklim değişikliği ile hava sıcaklıklarında artış, su seviyesinde yükselme, orman yangınları, kuraklık ve gıda krizi gibi kimi doğal afetler de günden güne artmaktadır. Artan doğal afetler ve değişen iklim koşulları iklim değişikliğinin “iklim krizi” adını almasına neden olmuştur. İklim krizi günümüzde tüm dünyayı derinden etkilemekte, yaşam koşullarını güç hale getirmektedir. İklim krizinin negatif sonuçlarından ise en çok kadınlar, çocuklar ve engelliler olmak üzere dezavantajlı gruplar etkilenmektedir.
İklim adaleti kavramı; yukarıda sayılan dezavantajlı grupların iklim değişikliğine hiçbir katkıları olmamasına karşın, olumsuz sonuçlarından daha fazla zarar görmelerini incelemektedir. En savunmasız grup içerisinde yer alan ve ailelerine bağımlı olan çocuklar da iklim krizi sebebiyle olumsuz etkilenmektedirler. Geçmiş kuşakların sonraki nesilleri umursamadan doğal kaynakları tüketmeleri ve sera gazlarını atmosfere salmaları; günümüz çocuklarına ve gelecek nesillere yaşanamaz bir iklim ve gittikçe zorlaşan hayat koşulları bırakılmasına neden olmuştur.
Uluslararası belgelerde ve Anayasamızda da korunan çocuk hakları, iklim krizi ve iklim adaletsizliği sebebiyle her yönden etkilenmektedir. Devletlerin ise iklim değişikliğinin etkilerini önleme ve dezavantajlı yani hassas grupların daha fazla kötü duruma düşmelerini engelleme yükümlülüğü bulunmaktadır. Bu kapsamda korunması gereken çocuklar için devletlerin bazı eylemlerde bulunması gerekmektedir.
Çalışmada iklim krizi, iklim adaleti ve çocuk hakkı kavramları tanımlandıktan sonra, ulusal ve uluslararası hukukta korunan çocuk hakları sıralanmış, bu hakların iklim krizi sebebiyle hangi açılardan etkilendiği belirtilmiştir. Ayrıca Avrupa İnsan Hakları Mahkemesi ve Birleşmiş Milletler başta olmak üzere yapılan uluslararası başvurular incelenmiş, son olarak çocuk haklarının uzun vadede daha da kötü etkilenmemesi için öneriler sunulmuştur.
