Aile hekimliği ülkemizde yeni bir müessese olarak idare hukuku ilkeleri içerisinde şekillendirilmiş bir müessesedir. Aile hekimlerinin atanma usulleri tamamen idare hukuku ilkeleri doğrultusunda gerçekleştirilmektedir. Söz konusu hekimlerin hastalarına tıbbi teşhis ve tedavi sırasında verdikleri zararlarından dolayı idareye karşı dava açılabilmektedir. İdare de zarar gören kişiye ödediği tazminatı ilgili hekimden talep etmesi gerekmektedir. İdarenin hekime karşı talebi idare hukuk çerçevesinde olmayıp ancak yapılan atıf dolayısıyla adli mahkemelerde özel hukuk hükümleri doğrultusunda dava açılabilmektedir. Açılan dava tamamen TBK. m. 49 vd. hükümlerine tabi
olacaktır. Ancak bu hükümlerden farklı olarak uygulanacak zamanaşımı hükümleri için TBK. m. 73 uygulama alanı bulur.
Family practice, as a new institute in our country, is an institution that is formed within administrative law principles. The appointment procedures of
family physicians are completely carried out in accordance with the principles of administrative law. The administration can be sued because of the damage that the abovementioned physicians cause to the patients during the medical diagnosis and treatments. In this respect, it seems to be essential that the administration must require the compensation, which was paid to the injured person, from the interested physician. It is interesting to highlight that this demand of the administration against physician is not settled within the framework of administrative law, but it can be prosecuted in the court of justice in accordance with the provisions of private of law due to the reference that is made in the law. The lawsuit will entirely subject to Article 49 and the continued provisions of the Turkish Code of Obligations. However, unlike those provisions, Article 73 of the Turkish Code of Obligations takes the leading for the provisions of the statute of limitations.
