Abstract
Bu makale çalışması, Joseph Raz’m bir hukuk sistemi için önemli saydığı “otorite” kavramını ve Raz açısından bu kavramla uyuşmazlık içinde bulunan “dahil edici tez” (incorporation thesis) ile “tutarlılık tezi”ni (coherence thesis) incelemeyi amaçlamaktadır. Raz, otorite kavramına dayanarak, H. L. A. Hart tarafından savunulan “dahil edici tez” ile Ronald Dworkin tarafından savunulan “tutarlılık tezi”ne karşı gelmektedir. Çünkü Raz açısından söz konusu iki tez otorite kavramıyla bağdaşmamaktatır. Otorite kavramını kaynak temelli (source-based) tezle bağdaştıran Raz, dışlayıcı pozitivist (exclusive positivist) olarak nitelendirilmektedir.
