The istidane establishment, which means indebtedness on behalf of
someone else, was heavily applied during the Ottoman period. This
establishment has provided social security to people when social security is not
as institutionalized as it is today. Today, however, the contens, covering and
conditions of this establishment are not much emphasized. For this reason, our
study aims to explain the establishment of istidane in general.
Our work has benefited from basic fiqh books, Ottoman court records and
relevant works on this subject to designated the covering of this establishment.
In terms of present-day law, it is possible to find examples of this establishment
in matters concerning curatorship, tutelage, management of foundatitons and
representation of conjugal community. However, the numbers are quite limited
when compared to Ottoman period. Nowadays, the implementation of this
establishment in case of need, especially in the field of private law, may be a
solution to disputes
