AN ASSAY ABOUT THE NATURE OF IJMA IN TERMS OF BEING A SHARIA EVIDENCE

Abstract

Islamic law scholars have quite different opinions from each other on the nature of ijma. However, so much so that the majority of the islamic law scholars count the ijma among the sharia evidences, some of them see it as an information of “tool and method” to ascertain the sharia provision from the sharia evidences in order to understand nas, ensure trust and safety in law.  Also, while these scholars tell the ijma narrows the field of ijtihad and prevents the dynamisms of islamic law, the other group of scholars which count the ijma among the sharia evidences see the comments, except the classical period ijma approach, as conscious, a sectarian hostility as devastating the security of law. What could be the reasons of generating thoughts on the nature of the ijma by the Islamic law scholars? In this study, it is aimed to make a synthesis by analyzing the reasons of comments which are about the concept of the nature of the ijma in terms of a sharia evidence, tool and method.

ŞER’Î BİR DELİL OLMA AÇISINDAN İCMANIN MAHİYETİ HAKKINDA BİR TAHLİL

Abstract

İslâm hukuk bilginleri, icmanın mahiyeti üzerinde birbirinden oldukça farklı görüşlere sahiptirler. Öyle ki çoğunluk icma’yı, aslî şer’î deliller arasında sayarken; bir kısmı da nasların anlaşılmasında, hukukta emniyet ve güveni sağlamada, şer’î delillerden şer’î hükümleri çıkarmada bir “araç ve yöntem” bilgisi olarak görürler. Keza bu bilginler icmanın, içtihat alanını daralttığını, İslâm hukukunun dinamizmine engel olduğunu söylerken; icmayı şerî deliller arasında sayan diğer bir grup bilginler ise klasik dönem icma anlayışının dışındaki yorumları; bilinçli, hukuk güvenliğini sarsıcı bir mezhep düşmanlığı olarak görmektedirler. İslâm hukuk bilginlerinin icmanın mahiyeti üzerinde bu kadar farklı düşünce üretmelerinin gerekçeleri ne olabilir? Bu çalışmada şer’î bir delil, araç ve yöntem olması açısından icma kavramının mahiyeti hakkındaki yorumların gerekçeleri analiz edilerek bir sentez yapılması amaçlanmıştır.
