ANAYASA MAHKEMESİ’NİN SINIR DIŞI KARARLARININ ANALİZİ VE YAPAY ZEKÂ KULLANIMI

Abstract

Arka plan: Göç hukukuna ilişkin karar süreçleri, bireylerin temel hak ve özgürlüklerini doğrudan etkileyen yüksek hassasiyetli alanlardan biridir. Bununla birlikte kararların hangi ölçüde öngörülebilir örüntüler içerdiği ve metinsel yapı ile sonuç arasındaki ilişkinin sistematik biçimde analiz edilip edilemeyeceği literatürde sınırlı biçimde ele alınmıştır. Amaç: Anayasa Mahkemesinin sınır dışı ve idari gözetim ile ilgili vermiş olduğu kararlar yorumlanarak anlaşılmaya çalışılacaktır. Bu şekilde göç ile ilgili görevi bulunan idari makamlara ve politika yapıcılara bir öngörü sunulmak istenmiştir. Ayrıca bu çalışma; göç hukukuna ilişkin karar metinlerinde ihlal sonucunun metin madenciliği ve denetimli makine öğrenmesi teknikleri kullanılarak tahmin edilip edilemeyeceğini test etmeyi ve elde edilen bulgular ışığında algoritmik karar destek sistemlerinin uygulanabilirliğini tartışmayı da amaçlamaktadır. Yöntem: Çalışmada karar metinleri incelenmiş, sınıflandırılarak tablolar haline getirilmiş ve bu tablolar üzerinden yorumlamalar yapılmıştır. Ayrıca karar metinleri TF-IDF temelli özellik çıkarımı yöntemiyle sayısallaştırılmış; Random Forest algoritması kullanılarak ikili sınıflandırma modeli oluşturulmuştur. Model performansı doğruluk, precision ve recall metrikleri üzerinden değerlendirilmiştir. Bulgular: Yapılan bireysel başvurulara dair yıl ve ülke bazlı istatistiki bilgiler elde edilmiştir. Oluşturulan tablolar üzerinden verilen kararlarla ilgili örüntülere ulaşılmıştır. Ayrıca, pilot model test verisi üzerinde %93 doğruluk oranı elde etmiştir. Özellikle ihlal sınıfında yüksek precision değeri, belirli metinsel örüntülerin karar sonucuyla ilişkili olabileceğini göstermektedir. Bununla birlikte recall değerinin görece düşük olması, modelin temkinli bir tahmin eğilimi sergilediğini ortaya koymaktadır. Sonuç: Elde edilen bulgular, göç hukukuna ilişkin kararların tamamen öngörülemez olmadığını ve belirli yapısal örüntüler içerdiğini göstermektedir. Bu durum, bağlayıcı olmayan ve insan denetimini dışlamayan yapay zekâ destekli karar analiz araçlarının geliştirilmesi için teorik bir zemin sunmaktadır.

ANALYSİS OF THE CONSTİTUTİONAL COURT’S DEPORTATİON DECİSİONS AND THE USE OF ARTİFİCİAL INTELLİGENCE

Abstract

Background: Migration law decision-making processes constitute highly sensitive areas that directly affect the fundamental rights and freedoms of individuals. However, the extent to which these decisions contain predictable patterns and whether the relationship between textual structure and outcomes can be systematically analyzed has been addressed only to a limited extent in the literature. Objective: The decisions rendered by the Constitutional Court concerning deportation and administrative detention will be analyzed and interpreted in order to better understand their legal reasoning and implications. In this way, the study aims to provide foresight and guidance to administrative authorities and policymakers responsible for migration-related matters. Furthermore, this study seeks to examine whether the outcome of violation findings in migration law decisions can be predicted through the use of text mining and supervised machine learning techniques. In the light of the findings obtained, the applicability of algorithmic decision-support systems in this field will also be discussed. Method: In this study, the decision texts were examined, categorized, and organized into tables, and interpretations were made based on these tabulated data. Furthermore, the decision texts were transformed into numerical representations using a TF-IDF–based feature extraction method. A binary classification model was then developed employing the Random Forest algorithm. The performance of the model was evaluated using accuracy, precision, and recall metrics. Findings: Statistical data regarding the duration of decisions on individual applications, as well as year- and country-based distributions, were obtained. Through the tables constructed, patterns related to the decisions rendered were identified. Moreover, the pilot model achieved an accuracy rate of 93% on the test dataset. In particular, the high precision value observed in the violation class suggests that certain textual patterns may be associated with the outcome of the decisions. However, the relatively lower recall value indicates that the model exhibits a cautious prediction tendency. Conclusion: The findings indicate that migration law decisions are not entirely unpredictable and contain identifiable structural patterns. This provides a theoretical basis for the development of AI-assisted decision analysis tools that are non-binding and do not exclude human oversight.
