EVALUATION OF ARRANGEMENTS ABOUT ADMINISTRATIVE SUPERVISION ON 2004 MUNICIPALITY REFORM STUDIES AND A RESEARCH

Abstract

For the purpose of performing local services that is suitable to the integrity
of administration, providing unity on public service, saving the benefit of society
and meeting the local needs properly, to carry out administrative supervision
that is a constitutional institution in Turkish administrative structure is
designated as a constitutional frame. Administrative supervision that appeared
as an application which constricts the autonomous structure of local
administration has a sensitive place on configuring an active and democratic
local administration. Administrative supervision applications that should be
integrated to the system by the constitutional reasons must be defined via the
content of not causing autonomous system to encounter with erosion. But when
the history of local administration is searched, it has been observed that
administrative supervision application is one of the tools by which central
management inspects the local administration.
Both municipality system of Ottoman and the character of municipality
system formed in Republic period caused municipality system to come out as a
system of supervision. While the municipality system was formed, this character
is forming the municipality structure as a tool of strenghten the central
administration in Ottomans and Republic period and of realizing an aim related
to save its authority in the provinces. While Ottoman central burocracy was
forming a municipality organization for providing a contribution to save the
Payitaht’s sovereignty against the senators in the provinces, Republic administrators
put forward a municipality structure that would allow to strenghten the
authority of central administration on the provinces. This status centre defined
for municipality brings the supervision of central administration together and
when it was joined to the traditional central structure of Turkish public administration,
one of the basic problems of municipality has been rigid supervision applications
on municipality. This situation has been appeared as the most important
obstacle for forming autonomous and strong municipality structure.
During historical process, the fact that Turkish municipality hasn’t been put
forward as an institution that will provide a contribution for spreading
democracy to base and the fact that it has been constructed as a unit of pure
service are the main reasons of the structure that municipality system stays
under supervision applications of central administration. This study has been
aimed to bring out the basic arrangements about administrative supervision in
2004 municipality reform which claims to bring out more democratic and
autonomous municipality structure, and on the frame of these arrangements to
measure the perception of local administrators related to arrangements that
realized about administrative supervision.

2004 BELEDİYE REFORM ÇALIŞMALARINDA İDARİ VESAYETE İLİŞKİN DÜZENLEMELERİNİN DEĞERLENDİRİLMESİ VE BİR ARAŞTIRMA

Abstract

Türk idare yapısında anayasal bir kurum olarak yer alan idari vesayetin mahallî hizmetlerin idarenin bütünlüğü ilkesine uygun şekilde yürütülmesi, kamu görevlerinde birliğin sağlanması, toplum yararının korunması ve mahallî ihtiyaçların gereği gibi karşılanması amacıyla uygulanması Anayasal bir çerçeve olarak belirlenmiştir. Mahalli idarelerin özerklik alanını daraltan bir uygulama olarak ortaya çıkan idari vesayet, etkin ve demokratik bir mahalli idare sistemi yapılandırmasında hassas bir yere sahiptir. Anayasal gerekçelerle sisteme entegre edilmesi gereken idari vesayet uygulamalarının mahalli idare sisteminin özerkliğini erozyona uğratmayacak bir içerikle tanımlanması gerekmektedir. Ancak mahalli idarelerin tarihsel gelişimi incelendiğinde idari vesayet uygulamaları çoğu zaman merkezi yönetimin mahalli idareleri sıkı denetim altında tutma araçlarından biri olarak ortaya çıkmıştır. 2004 yılından itibaren yapılan yasama işlemleri ile temel yerel yönetim kanunları yenilenmiştir. 1930 yılından beri yürürlükte bulunan 1580 sayılı kanunun yerini 5393 sayılı Kanun almıştır. Büyükşehir belediye kanunu, il özel idaresi kanunu yeni kanunlarla değiştirilmiş, mahalli idare birlikleri kanunu ilk kez çıkarılmıştır. Bu temel kanunlardan sonra da yerel yönetimlere ilişkin yeni yasalar çıkarılmıştır. Bu yasalarla yerel yönetimlerde bir anlayış değişikliği yaratıldığı söylenebilir. Bu makalede 2004 belediye reformu çerçevesinde Türk mahalli idare sisteminin temel birimi olan belediyeler üzerindeki idari vesayet uygulamaları ve bu uygulamalara yerel yöneticilerin bakışı ele alınacaktır.
