Abstract

Bu çalışma, antik Yunan’da M.Ö. 5. yüzyılın sonlarından itibaren ortaya çıkan ve tiranlara karşı cinayet işlemeyi suç olmaktan çıkararak katillere karşı yaptırımsızlığı ve hatta ödüllendirmeyi öngören tiran karşıtı hukuki düzenlemeleri detaylı bir şekilde incelemektedir. Tiran katli olarak ifade edilen bu pratik, kısaca devlet gücünü sistematik bir baskı aracı olarak kullanan yöneticilere karşı işlenen siyasi cinayettir. M.Ö. 410 yılından M.Ö. 280 yılına kadarki dönemde, Atina ve diğer bazı şehir devletlerinde yürürlüğe giren beş anti-tiran yasa metni tarihi arka planları ile detaylı bir analize tabi tutulmuş ve direnme hakkı olarak bazı modern anayasalarda da geçen uygulamanın en radikal örneklerinin hukuki dayanakları incelenmiştir.
