Yabancılar ve Uluslararası Koruma Kanunu Hakkında Genel Bir Değerlendirme

Abstract

Uzun bir danışma sürecinin sonunda kapsamlı yeni Yabancılar Uluslararası Koruma Kanunu Nisan 2013’te kabul edilmiştir. Çalışma bu kanunun bireylerin korunması, ve gözetim altına alınmış göçmenlerin ve geri çevrilen sığınmacıların geri gönderilmesine etkilerini insan güvensizliği yaklaşımı ile incelemektedir. Yeni kurulan Göç İdaresi Genel Müdürlüğü yeni kanun ile bütünsel, birleşik bir sistem oluşturarak olumlu bir adım atmıştır. Geri gönderme yeni kanun ile yeniden yapılandırılmıştır. Kanun sadece Türkiye’deki uygulama ve deneyimlere dayanarak değil, dünyadaki en iyi örneklere göre yapılandırılmıştır. Dolayısıyla, genel olarak olumlu ve insani öncelikli bir yaklaşım sergilemektedir

A General Review of Foreigners and International Protection Law

Abstract

Following a relatively long process of consultation, the new comprehensive law on foreigners and international protection came into force in April 2013. This study focuses on the implications of this law for the protection of individuals and the deportation of apprehended immigrants and refused asylum seekers from a human insecurity perspective. A unified system proposed by the new law, along with the newly created General Directorate of Migration, is a positive step. The deportation is restructured by the new law. It has been redesigned not only based on the practices and experiences in Turkey, but also based on the best practices around the world
