A BROAD OVERVIEW OF MEDICAL MALPRACTICE LIABILITY POLICY IN TURKEY
Abstract
The importance of health law has grown over the years at international and national level. An important element of health law is the use of law to promote good and effective health. Health law concerned with a number of issues which have arisen from health care services, both civil, political, cultural economic and social rights. Thus, health law shares conceptual terrain with the fields of health policy.
The impact of internationalization health care on health-policy making will cause legalization of rules in the health law field. Health policy may impact on the health outcomes such as health service costs, patient physician relationships, and quality of health services received.
This study examines structural and regulatory standpoints that shape Turkish health law policy. In order to mention that, it has been assessed government structure of health care, health insurance policy besides regulatory framework e.g. medical liability systems and medical malpractice under civil law and criminal law. Based on the qualitative and quantitative scientific evidence on the effects of Turkey health policy, it has been discussed key lessons and implications for policy-makers to resolve difficult health law policy problems in future.
