Bir İnsan Hakları Kategorisi Olarak İnsan Onuru Kavramı ve Türkiye’deki Uygulaması Üzerine Bir Analiz

Abstract

İnsan onuru kategorisi, insan haklarının ontolojik temelini oluşturur ve meşruluk sağlar. Böyle olmakla, insan haklarının ahlaki yükümlülüklerini de hatırlatır. Ne var ki bu çalışmada biz, kavramı yalnızca dilsel, ahlaki, politik, tarihsel ve felsefi anlamlarında bir analizini sunmakla kalmamayı, bunun yanında -ya da esas olarak demeliyiz- kavramın hak temelli hukukun özel bağlamındaki anlamını da ortaya koymayı amaçladık. Böyle olmakla hak temelli hukuk bağlamında insan onurunun devlet organları arasındaki ilişkiye bağlı olan özel bağlamı da dâhil olmak üzere yatay etkilerini de doğrudan alanını teşkil ettiğini belirttik. Bu çalışmadaki amacımız insan onuru fikrini hak temelli hukuk doğrultusunda savunmaktır.

An Analysis on the Concept of Human Dignity as a Category of Human Rights and Its Application in Turkey

Abstract

The category of human dignity forms the ontological basis of human rights and provides legitimacy. It also reminds of the moral obligations of human rights. However, in this study, we aimed not only to present an analysis of the concept in its linguistic, moral, political, historical and philosophical meanings, but also - or we should say mainly - to reveal the meaning of the concept in the special context of rights-based law. As such, we have stated that in the context of rights-based law, human dignity also directly constitutes its horizontal effects, including its special context, which depends on the relationship between state organs. Our aim in this study is to defend the idea of human dignity in line with rights-based law.
